Regulators accuse Las Vegas doctor of dispensing drugs without an exam

CARSON CITY — The state Board of Medical Examiners has filed a complaint against longtime Las Vegas physician Dr. John J. Dudek Jr. accusing him of allowing dangerous drugs to be dispensed without an examination of the patient.

Dudek, a urologist, has 20 days to answer the four-count complaint and seek a hearing before the board. Dudek rents office space to nurse Riveka Frey, who operates Facial Enhancements by Reva. He reportedly acts as medical director but the complaint says Dudek "has little or no training or experience in the performance of facial cosmetic procedures."

"Dr. Dudek, until very recently, knowingly allowed Ms. Frey to order dangerous drugs, including, but not limited to Botox, Restylane, Juvederm and other dangerous drugs used commonly in cosmetic procedures, through his account with the drug wholesalers," according to the complaint drafted by board counsel Lyn E. Beggs.

Frey would tell Dudek's office manager what drugs she would need and then pay for them with her credit card.

One of the dangerous drugs ordered by Dudek was Latisse. The law says a licensed physician may only dispense dangerous drugs if authorized by the state Board of Pharmacy and Dudek does not have a certificate of registration for that approval.

The complaint said Dudek is not qualified "to have performed the evaluations or make the diagnoses and treatment determinations for those patients that saw Ms. Frey in her independent practice operating in Dr. Dudek's Office."

The board said Dr. Dudek violated the law by allowing Frey "to possess and administer dangerous drugs to patients for whom he had not evaluated, diagnosed, nor prescribed dangerous drugs."
