Righthaven hits another snag with copyright lawsuit

Copyright lawsuit filer Righthaven LLC was hit with another setback on Thursday — this time in South Carolina.
U.S. Magistrate Judge Jacquelyn Austin in Greenville gave the Las Vegas company until Oct. 28 to show cause why its lone lawsuit in that state should not be dismissed.
Righthaven had sued Tea Party activist Dana Eiser over allegations she posted a Denver Post column online without authorization — charges denied by Eiser.
Austin, in Thursday’s order, noted judges in Nevada and Colorado have already found Righthaven lacked standing to sue under its lawsuit contracts with the Post and the Las Vegas Review-Journal.
She noted copyright plaintiffs have to have exclusive rights in material they sue over — and Righthaven has been found by a judge in Denver to own no such rights under the Post lawsuit contract.

What's worse, "barratry" can also carry a criminal charge in South Carolina. If this case is dismissed it could provide fodder for further action against Righthaven there.
It appears that Righthaven looked far enough into this game to review possible profits. They did not look at all the rules of the game or expect people to fight back.
Very soon there is going to be a newsflash about Righthaven filing BK trying to get out from under this failed game of theirs.
Hopefully the courts are not going to let them bail that easily and hold the principles responsible for all the money they cost others.
