Nevada Supreme Court hearings scheduled this week in Las Vegas

The Nevada Supreme Court will conduct hearings at the Regional Justice Center next week to consider numerous appeals of decisions issued in Clark County District Court.

Monday's schedule

Rinker Materials West v. District Court -- The dispute centers on whether Rinker employee Thomas O'Connor, who was injured in an accident while driving a vehicle as part of his job, is entitled under state law to have Rinker pay for his medication after the company already paid him a lump sum for his permanent partial disability.

City of North Las Vegas v. Warburton -- The case involves city employee Mallory Warburton, who was promoted to pool manager shortly before she was injured in an auto accident while conducting city business. At the time of the accident, though, she was still being paid a lower wage as a water safety instructor because the paperwork for the promotion had not been processed. The dispute is whether she should receive workers' compensation based on the higher pool manager wage or the lower lifeguard wage.

Gibbs v. Nevada Department of Health and Human Services -- A central issue is whether a large settlement from a medical malpractice action that was received by a severely disabled child and placed in a special needs trust should count toward the child's eligibility for Medicaid assistance.

Citizen Outreach v. Clark County -- The case centers on whether the county can require any contractor or subcontractor working on a public works project to enter into a Public Labor Agreement. The dispute in this case involves bids that were solicited to renovate the Clark County Detention Center North Tower.

Tuesday's schedule

Stiles v. State of Nevada -- Chester Stiles was convicted of sexually abusing two girls, ages 2 and 6. Among the issues the Supreme Court will consider in Stiles' appeal is whether the criminal charges associated with both victims should be severed and whether the District Court erred by admitting hearsay statements.

Physicians Insurance Company of Wisconsin v. Williams -- Glenn Williams went to a dentist who claimed to use cocaine as an anesthetic on patients. The dentist was later arrested for cocaine possession. Williams, who was fired from his job after failing a drug test following a work-related accident, filed a complaint against the dentist and his business and received default judgments against both. The issue in this case is whether Williams is also entitled to a judgment from the insurance company, the dentist's malpractice carrier.

Stickney v. Valley Health System -- Alyssan Stickney claims to have been injured due to negligence by Valley Health System but lost her trial. The Supreme Court will decide whether Stickney is entitled to a new trial in part because the District Court precluded her physician from testifying on what caused her injury. The lower court barred the testimony because the doctor wasn't present when the injury occurred and because Stickney failed to list the physician as an expert witness.

Wednesday's schedule

DeCastro v. State of Nevada -- Castro DeCastro is appealing his conviction for sexual assault and lewdness involving a girl under age 14. The Supreme Court will decide whether DeCastro was precluded from fully presenting a defense theory and whether a mistrial should have been granted after it was discovered that a juror lived on the same street as the crime scene.
