Henderson company hit with $6 million jury verdict

Beyond Commerce Inc., a small Henderson e-commerce company, was hit Wednesday with a $6.02 million jury verdict in a federal lawsuit with a former executive.

Beyond Commerce, formerly known as BOOMj.com Inc., in 2008 sued George Pursglove, its former CEO who had resigned, alleging breach of confidentiality and non-compete agreements and breach of fiduciary duty.

Pursglove fired back with a counterclaim alleging breach of contract for nonpayment of his final wages and for stock he had been promised.

He also alleged Beyond Commerce interfered with his efforts to launch a new business.

A federal jury on Wednesday awarded Pursglove $20,775 in back wages, $3 million for his claim that the company failed to pay him 3.4 million shares of stock as promised and $3 million in punitive damages.

Beyond Commerce, a penny stock company, reported less than $3 million in assets as of Sept. 30, 2010, so it’s unclear how or when the judgment would be paid by the company or its insurers.

Las Vegas attorney Gus Flangas of Flangas McMillan Law Group, one of the attorneys who represented Pursglove, said in a statement: “The case was such that my client had been dealt a disservice, and we are gratified that a jury of his peers agreed.”
