Appeals court raises more questions

Regarding a federal appeals court decision last week on a national health care law:

Tossing out the insurance mandate in the president’s health care bill would do nothing to improve the availability or choices for medical care. It simply would answer a question with a question. How would the medically uninsured receive health care, and who would actually pay for it?

Furthermore, would the taxpayer be left on the hook for providing care to the uninsured, and would hospitals still be required to admit such persons, knowing that their costs would likely be uncovered? If this is supposed to be some kind of victory, it seems that there is little to celebrate.
