State board looks to ban sale, use of synthetic marijuana

The Nevada Board of Pharmacy voted Thursday to draft a regulation that would ban statewide the sale or use of five synthetic marijuana chemicals that the Drug Enforcement Administration intends to temporarily outlaw nationally.

The board action was prompted by concerns that were brought to it in September by Northern Nevada law enforcement officials, including Douglas County District Attorney Mark Jackson.

Jackson told the board that fake pot, which is marketed as herbal incense sold at smoke shops and online, is far stronger than THC, the active ingredient in marijuana.

The earliest the board could vote on the proposed final regulation would be at its meeting in early March, said Jeri Walter, the board's coordinator. Even then, the regulation would have to be reviewed by the Legislative Commission — a panel of state legislators who supervise the Legislative Counsel Bureau — before it takes effect.

The five chemicals are JWH-018, JWH-073, JWH-200, CP-47,497 and cannabicyclohexanol.

Separate from the board action, Assemblyman-elect John Ellison, R-Elko, also intends to submit a bill for consideration by the Legislature next year that would ban synthetic marijuana products statewide.
