PHOENIX -- Gov. Jan Brewer ignored criticism from President Barack Obama on Friday and signed into law a bill supporters said would take handcuffs off police in dealing with illegal immigration in Arizona, the nation's gateway for human and drug smugglers.
With hundreds of people surrounding the state Capitol, protesting that the bill would lead to civil rights abuses, Brewer said she wouldn't tolerate racial profiling. She said critics were "overreacting."
"We in Arizona have been more than patient waiting for Washington to act," Brewer said after signing the law. "But decades of inaction and misguided policy have created a dangerous and unacceptable situation."
Obama said earlier Friday that he's instructed the Justice Department to examine the Arizona bill to see if it's legal, and said the federal government must enact immigration reform at the national level - or leave the door open to "irresponsibility by others."
"That includes, for example, the recent efforts in Arizona, which threaten to undermine basic notions of fairness that we cherish as Americans, as well as the trust between police and their communities that is so crucial to keeping us safe," Obama said.
The bill, sent to the Republican governor by the GOP-led Legislature, would make it a crime under state law to be in the country illegally. It would also require local police officers to question people about their immigration status if there is reason to suspect they are illegal immigrants.
The bill takes effect 90 days after the legislative session ends in the next several weeks.
Demonstrators have been camped outside the Capitol since the measure passed out of the Legislature on Monday. Their numbers have grown steadily throughout the week, with buses bringing protesters from as far away as Los Angeles.
Brewer, who faces a tough election battle and growing anger in the state over illegal immigrants, said the law "protects every Arizona citizen."
Arizona has an estimated 460,000 illegal immigrants and is the state with the most illegal border crossings, with the harsh, remote desert serving as the gateway for thousands of Mexicans and Central Americans.
U.S. Rep. Raul Grijalva, a Democrat who opposes the measure, said he's closing his Arizona offices at noon Friday after his staff in Yuma and Tucson were flooded with calls this week, some from people threatening violent acts and shouting racial slurs.
The bill's Republican sponsor, state Rep. Russell Pearce of Mesa, said Obama and other critics of the bill were "against law enforcement, our citizens and the rule of law."
Pearce said the legislation would remove "political handcuffs" from police and help drive illegal immigrants from the state.
"Illegal is illegal," said Pearce, a driving force on the issue in Arizona. "We'll have less crime. We'll have lower taxes. We'll have safer neighborhoods. We'll have shorter lines in the emergency rooms. We'll have smaller classrooms."
Other provisions of the bill allow lawsuits against government agencies that hinder enforcement of immigration laws, and make it illegal to hire illegal immigrants for day labor or knowingly transport them.






I find it strange to describe this as the toughest law in the land when the key parts were lifted ver-batum from the federal law according to the Governor.
If the wording is the same, then that means we have a tough federal law that simply isn't being enforced. I think that having an identical state law that allows for enforcement at the state level is an interesting approach. I'll be watching how this plays out with interest.
It is interesting. I don't know much about it, but I've wondered why being in the country "illegally" isn't enforced more. I hope it doesn't open up the door for the unnecessary harassment of people that are there legally, but there are some very basic things that can be enforced that aren't currently. Any time a person goes through any public system (police, DMV, hospital, etc.), there should be a verification process that they are here legally. If not, immigration should be notified and they should be deported. It sounds easy, but I don't know the arguments on the other side. Anyone care to enlighten me?
Its about time !! hopefully other boarder states will follow suit, and force the federal government to take this issue seriously. If arizona keeps passing these kind of laws, I might just move there !!!
As liberal as I am I believe this is a good step in the need for radical change. No one can dispute that there is a serious crime and social burden with the illegal residents. Let us hope our politicians learn that their tendancy to compromise has led to some serious problems in our society. I have traveled and worked in many countries. Like most honest people I do what is legal and get another stamp in my passport and a visa. To pretend that enforcing simple laws of border crossing is an overt violation of civil rights is simply not logical reasoning. No one has any right to break the law. No one. It is as simple as that.

Yes, round them up. We need a final solution to the problem. We need ID chips embedded in people and cloth badges sewn on clothing and numerical tattoos on the skin to quickly identify the undesirables. How many of these undesirables work in the casinos, hotels, restaurants, country clubs, wealthy homes and gardens?
As a Latino-American, I am in a very select group that believes that immigration must be done legally and orderly. I am not anti-immigration. I'm a second generation American and feel everyone that wants to live and work in our great country should be here legally.
The main problem I have however is with the numerous employers that hire illegal immigrants. That said, the moment prices may or may not increase on cheap goods, many will stupidly blame politicians.
Let's also recall that in states like Texas, many Republicans, including former president Bush II, catered to Latinos.
I hate, absolutely hate, finding myself on the same side of many conservative, xenophobic and racist idiots on this issue.
Ultimately, immigrants that come here legally are less susceptible to be mistreated by employers, which they are in large measure, as they pay them below minimum wages, provide negligible work environments, and no benefits.

As for the law itself, yes, if you're not here legally, you must be deported. Will there be a strong possibility of harassment of Americans of Latino descent who are citizens or naturalized citizens? Absolutely. And I strongly endorse these people's rights to sue the snot out of local Arizona police.

ThisOneGuy, you're probably right, and it's what I expect. That legal residents will be unnecessarily harassed. It sounds like that's the problem with this particular law in AZ. There's somewhere between doing nothing and giving the police the green light to screw with anyone they want, and use dark physical features as reasonable cause. I think they should start by checking citizenship status when they run their info through any public computer system. Based on what I've heard, they don't do that now. Even for criminals that go to court, get a public defender, etc.
There are too many people that are here legally that make a contribution to the country, the challenge is distinguishing them from the ones that are NOT here legally. Very tough issue.
For those that oppose...what would you recommend as an alternative to identifying and deporting illegal immigrants? I DEFINITELY agree with placing heavy fines on the employers. A good portion of them know damn well what they're doing, and deserve fines. I'm talking landscaping groups, pool companies, and even companies in regulated industries. Yes, prices will go up, but more of us might have to get off our fat butts and mow our own lawns, clean our own pools, etc.

The rights you are describing are human rights not civil rights. Illegal immigrants are different from non-citizens in the sense that all illegal immigrants are non-citizens, but not all non-citizens are illegal immigrants. Illegal immigrants have NO rights in this country. They are here illegally and thus are not covered under our constitution or the bill of rights. I firmly believe that all illegals should be rounded up and deported. A non-citizen who is here legally would have some sort of visa or other authorizing document allowing them to be in the country. Arizona is doing a great thing allowing police to check for documents (assuming there is probable suspicion). All states should pass a similar bill. I have absolutely no sympathy for people knowingly breaking the laws of my country. We need to make it harder and harder on the illegals until they leave.
Obama's response to this law should be an eye opener for anyone expecting him to seriously tackle the immigration issue...

Asides from that - I've lived in AZ for 21 years. If some posters more on the left think NV is bad, try living here. First - the law doesn't let a cop just stop someone. The theory is after a reason for a stop like running a stop light, speeding, etc., happens, if the person then can't show a driver's license and doesn't speak English, that would be enough for the cop to get into the illegal immigrant questioning. Now having said that, the amount of arrests will totally kill the court system. The state is so broke its about to lay off almost ALL of its court staff if a new tax isn't passed by the voters in May.
Brewer was NOT elected Governor. She was appointed after being Secretary of State when Governor Napolitano was tapped to go to D.C. for Homeland Security. She's also one of those nut bag governors who wants to waste tax payer money suing Washington over health care when the state doesn't have the money for that lawsuit, the future immigrant law suits and its own state employees. She has a ZERO chance for re-election as she faces a tough primary. Not to mention she just handed the election over to the Democratic candidate.

There is a similar story on AOL, Gov. Brewer plans to train the officers regarding the racial profiling concern.

chediski, I don't really see the problem with the scenario of stopping for a traffic violation/no proof of citizenship. I don't think they should go to AZ jails (at least, not for long) and cost the state much money, it should be a federal issue handled by the federal agencies. Not that the country isn't also broke, but if this is a priority that they want to address, then that's what it would take. I'm not really up on these laws, just giving my opinion on how it should be.
We can call it an annexation and we would have all those jobs back on American soil.
And open a hot line so if someone suspects a local merchant of employing them they can report it and the police can follow up and actually issue a citation and then you will see them leave the area.

Immigrants DO, in fact, have rights in this country; both human and civil.
If a person here illegally commits a crime he or she is entitled to the same protections as a citizen: jury trial, legal representation, Miranda warnings etc. So they are, in fact, covered under our Bill of rights and Constitution.

All Nevada candidates should be asked if they support a similar law in Nevada. I called Sandoval's campaign office and politely asked, and his staffer swore at me in Spanish and hung up on me. Does Sandoval now have a fear of going to Arizona?

@improvelv - the thing is if an officer stops someone who doesn't have a driver's license and can't speak the language, they're brought to jail anyway for the appropriate background checks. I mean - this is what they already do.
But asides from that, there are things that are question marks. How much of the officer's time is now taken to arrest the "suspect" and question them when they could be responding to a burglary call? Does someone come by and pick him up? And the state police chiefs were against it because of the civil lawsuits that could occur against them. As the President said, the inaction of the Feds in this topic makes it so states have to try to do things themselves. If anything else I hope this brings to the forefront this topic and get it handled.
The thing that really got this off the ground was the tragic killing of an AZ rancher a couple of months ago.
It is a sad state of affairs and it's a very frustrating one. I think the vast majority of Americans are against any illegal immigration - even those who got here legally - but I feel the old adage of "asking for papers" is too great a trade-off. On the other hand, this has resurrected the National I.D. card once again - maybe that's the way to go since it would be the same for all. If a person can't prove they are, they get arrested and held accountable for breaking the law. What a novel concept.
Is America a country of resolute laws; many folks tend to accept that as true, but that is not the case, we the people have the power to override or redefine the laws, constitution as we see fit via a jury, the ballot box or a constitutional quorum.
The laws and the constitution of America are ever changing, as do the winds of politics in our country, the induction of a new Supreme Court Judge to interpret our laws have swayed past understandings, historically overturning prior rulings. We the people as a whole will decided what immigration policies are right for us as a country, not any single state or minority group of people with vested interests.
For those of us Americans that travel and have vest interests abroad, as do I, it must be recognized that the implications of what America does in the homeland may and has been felt in the past by those of us Americans living, working or vacationing abroad. I can't count on two hands how many times I have been able to evoke "American" in many countries without fear of being arrested and questioned, as to my legitimacy of purpose or intentions in that country.
As for questioning people who speak the Queen's English if stopped by police or any governmental agency, I find that appalling, to think that under the first amendment I have a right to speak any language in America with or without accent and not be suspect; have we no measure.
To measure, profile people is a panacea used to cover an ulterior agenda, the eyes of the world are upon us, what we do and how we treat people may haunt us, at least those of us Americans that travel to other countries.

I find it interesting that during the last 20 or so years when the economy was doing ok illegals were viewed by many as helpfull to most US citizens wanting to cut there labor costs by paying them 1/4 to 1/2 the salaries that non illegals were getting. All the while complaining that unions, labor rights and benefits were driving them (the business owner) out of business...now that the economy is down the same business owners and others in arizona are looking around and stating in suprise "what are all these illegals doing here...get them out we dont want them anymore"...well i am not suprised by this...during down times in economys it is not uncommon to blame the poor and weak for their problems...look at germany in the late 30s...

Passage of this bill will elicit emotions. A lot of emotions. Aside from the whaling issue this is one of the first departures I have from our president. I agree with his health care plan yet disagree stongly that this bill is a bad thing.
I grew up in Arizona and do not have a single molecule of racial bias.
But I have seen the crime first hand. I have seen the casual disregard for the laws. I have seen the violence.
For me the loss of my own civil rights in a hypothetical traffic stop is a trade I would gladly make to reduce crime. For me the emotion is simple: I hate criminals with a passion.
The murder of the southern Arizona rancher was a driving force behind this bill. I hear they shot
him, his dog, and his horse.
I hold their lives above any hypothetical inconvienance anyone may experience.
It is the casual, CASUAL, disregard that has created this situation. It is more than time for such a wake up call.
The only people who protest this law are illegal aliens, employers who hire illegal aliens or family and friends of illegal aliens. But I fear this is just another law that can not and/or will not be enforced. I believe it will be enforced on employers when donkeys fly. Certainly not in this economic climate. Greed and corruption will prevail there.
We, as citizens, do not have to accept the non-enforcement of our laws. In order to reduce crime
we need to be more proactive. We need to document what we can and put in our complaints. It is up to us to keep pressure on those forming policy and to shed light on those breaking the law.
Make some noise.
If you know an employeer is breaking the law take the time to contact the enforcers. If they do nothing follow up. Be persistant. We need to exert ourselves as citizens to avoid the state of non-action. Wrong doers know well the effectiveness of doing nothing. Let the assumption that no one will do anything about it be a thing of the past.

People get all wrapped up in the notion that these folks are here illegally, that law-and-order is all important for immigrants - but possibly less so for everyone else, especially if you were lucky enough to be born here.
The question remains, is it the fact that they are here with out the proper paperwork, or (more likely) that they look different and speak a different language? If they had papers would you accept them as Americans?
You do understand that we went through this with the Irish, Italians, the Jews, the Poles and the Chinese, right? Read some history, go tour the Statue of Liberty and try to not be so scared of your fellow human beings.
The key to immirgration enforcement is at the employer level and at the government services level. Deny both of those to illegal immigrants and they have no choice but to leave or starve. Make it plain that neither are available and they won't come here in the first place.
E-Verify is a good idea, but it's not being used. Welfare doesn't even bother to ask. That's where real enforcement needs to be done.
I'm all for legal immigration, but the operative word there is "legal". There is no doubt that enforcement at the individual level really does raise serious questions about personal liberty, but enforcement at the employment and government services level does not.

An illegal act should never be a step toward becoming a citizen. The solution is simple and actually costs nothing. If you are here illegally, you will never be a citizen. Period. That being said, the anchor baby is no longer an anchor because their parent can never be a citizen. Give them (parents) legal work permit status for a fee, and allow them to stay and work for life while paying higher income tax for breaking the law. That is it.

More to the point of this story, the AZ law is a reaction to the lack of action on the federal government's part. Everyone posting here are the descendants of immigrants. At the same time, almost all of those immigrants came here legally at the time and our nation needed them to help grow the economy.
That is not the case today. If we are going to continue down the path to more and more government programs (which I disagree with) then we *must* restrict those programs to citizens only. Arizona is making the statement that it values the welfare of its citizens above the welfare of those who wish to mooch. No citizen should have a problem with that.
This is not a State problem it is a Federal problem. The fact that a State has to step up to a Federal responsibility is just sad. The Feds just wont take responsibility for detention or transport away from the border.
The Law is already in place and if stopped on or near a border you will be deported. The problem is if you get past that initial say 50 miles or so, there is no one to come and get you and no place to put you anyway while waiting for someone to come get you.
For Law Enforcement this is extremely frustrating. Stereotyping is not necessary. Coming into contact with illegal immigrants is commonplace without any effort at all. Have you ever stopped a car for running a stop light, found out the driver is here illegally and has no driver's license or insurance? How do you even write this person a ticket? You don't know who the hell he is.
Heaven forbid you're the one who gets rear ended in a traffic accident by that same person. You better have good insurance because more often than not his isn't any good.
Try putting a common Hispanic name in a criminal data base and see how many warrants pop up for people who were issued citations under aliases or uncheck able information. See how many names pop up. ***Thousands***

This bill does not circumvent the human rights and constitutional rights against unreasonable search & seizure! No legislation can change that. This bill simply allows non-federal law enforcement to follow-up with immigration inquiry during the course of a justified stop - to paraphrase). Just like they do in all of Europe, Asia and Latin America.
70 % of Arizonans are for this bill! Do the math - those are not all Republicans for sure - There were about 12% undecided. You don't have to be Karl Rove to figure out the political impact of thos numbers.
In comparison, the Mexican immigration laws, authority to stop anyone they feel like it, military checkpoints, corrupt police shakedown post - whatever - are far worse than any American example.

Arizona is doing what it needs to do in lieu of the Federal Government taking effective action on immigration reform and border security. It is indeed a desperate, and perhaps unconstitutional measure, but it highlights the dangerous situation existing today in our border states, and to a significant extent, our entire country.

My grandfather was German and when my dad went into the US Army Air Core the officials came to interview my grandparents to make sure they were not spies. People of Japanese descent were rounded up during WWII. Sometimes the country has to do what it must to protect its' citizens so these things are going to happen. My grandparents did not sue because they were profiled.

Back in the late 70's early 80's, a similiar thing happened and they found that the angry illegals in the fields were doing exactly that, urinating and defecating, in, around and on the produce they were picking. There was an investigation after numerous people got sick from produce harvested at a particular farm, not that much different than the pimple faced kid spitting in your drink or food when you p*ssed them off.

In Mexico City, when they do an autopsy, they find fecal dust in people's lungs. These people are litterly choking to death from their own excrement due to overpopulation. But now, AZ has forced his hand and we will probably see another bad law hurriedly thrown together that nobody will read before voting on. They've already gutted requirements for E-Verify, now they'll pass something that makes it illegal for state and local law-enforcement to even ask for a driver's license if the person is Latino.

There is no argument that animal cruelty is horrific.
But to say that the law is an indication of AZ's mentality towards life in general is to ignore that various forms of animal fights are more popular among some groups than others and this law might in fact reduce the occurance of such fights in AZ. There are many news stories that talk about the problem in other countries whose populations might be affected by this law and the extraordinary (and largely ineffective) steps that have been taken to stamp out the practice.
