Neonopolis owner sued over past-due bill

The owner of the Neonopolis development in downtown Las Vegas has been sued over a past-due cooling bill.

The Galaxy movie theaters recently closed at the entertainment and retail center; and plans to open the Star Trek Experience attraction there have been delayed until next year at the earliest.

And last week a dispute over the delivery of chilled water to cool the complex resulted in a lawsuit claiming owner FAEC Holdings LLC and Wirrulla Hayward LLC have failed to pay monthly billings since October totaling more than $277,000.

Chilled water supplier E.Three Custom Energy Solutions LLC, which is owned by Ameresco Inc. of Framingham, Mass., filed the suit in Clark County District Court.

The plaintiffs say they have shut off the chilled water supply to the 250,000-square-foot complex, developed at a cost of $100 million at the corner of Las Vegas Boulevard and Fremont Street.

They also complained that Neonopolis official Rohit Joshi has asserted the defendants have no intention of complying with the chilled water contract and that Joshi has threatened to arrange for chilled water from other sources or install a chilled water plant.

E.Three says that when FAEC purchased Neonopolis in June 2006, it inherited the 20-year chilled water contract originally signed in 2001 with Neonopolis developer World Entertainment Centers LLC.

Joshi could not be reached for comment on the dispute Monday.
