Court rejects appeal of killer

CARSON CITY – Saturday will mark 26 years since Rodolfo Leon was convicted on two counts of first degree murder in Las Vegas.

But the Nevada Supreme Court didn’t give him any present.

The court this week rejected his petition that argued Leon’s trial counsel was ineffective for failing to inform the trial court he was deaf; the key witness was a drug user and the DNA of the blood on his clothes did not match the victims.

The court said the petition was filed almost 22 years after the direct appeal. It upheld District Judge Elissa Cadish who ruled the petition was untimely filed.

Leon was convicted of the ax murder of Leon Rodriguez and the beating death of Arnttia Ferguson in 1983.

Now 58-years-old, Leon is held at the Northern Nevada Correction Center in Carson City on two consecutive terms of life without parole.
