Suit against professor dismissed

UNLV prevailed Friday in the lawsuit that had been filed against a professor by a former student over a grade dispute.

The student failed to show up for the court date, so the lawsuit was dismissed.

Robert W. Whitney Jr., 52, a former history graduate student, was suing professor Andrew Bell in small claims court for failing to help him attain a graduate assistantship position or other scholarships during the 2003-2004 school year. Bell was then graduate coordinator for the history department.

Whitney also claimed Bell has abused his powers by refusing to allow Whitney to appeal a grade.

Whitney was seeking up to $5,000 in damages. When he failed to appear in court Friday, the court automatically dismissed the lawsuit.
