Inquest to rule on fatal shooting
Friday, Jan. 28, 2005 | 9:37 a.m.
A Clark County coroner's inquest jury was expected to decide today if a Metro Police officer acted lawfully in the fatal shooting of a man who allegedly attacked the officer with his own baton in the parking lot of the Fashion Show mall on Dec. 26.
Aquileo Jimenez-Duran, 21, had allegedly been trying to steal a vehicle from the mall parking lot and at first fled when Officer Jon David approached him, police said.
Then Jimenez-Duran suddenly turned and challenged David, police allege. The officer used his baton to subdue the man, then he used his Taser, but both failed to stop him, police said.
He allegedly grabbed David's baton and swung it at him, causing David to fire a fatal shot with his handgun.
David, 29, has been with the department for three years and is assigned to the South Central Area Command, police said. He has been on paid leave since the shooting.
Jimenez-Duran had no prior arrest record, police said.
