Water authority again seeks lawsuit dismissal

The Southern Nevada Water Authority apparently will file a second motion seeking to have a federal lawsuit brought by Nevada Power Co. dismissed.
The SNWA was encouraged by an order from Judge Robert C. Jones that last week affirmed his indication in a July hearing that he would throw out the authority's motion to dismiss the utility's lawsuit. That order, released last week, acknowledges arguments made by the SNWA and leaves open the door for a new filing.
"SNWA is invited to file another motion in which these issues are more fully discussed," the order said.
Those issues revolve around the Federal Energy Regulatory Commission's authority over issues involving power rates, refunds and contracts.
When asked if the SNWA would file another motion to dismiss, spokesman Vince Alberta said: "We will."
Nevada Power sued the SNWA and individuals working with the Colorado River Commission and Enron Corp. in March, claiming they conspired to harm the Las Vegas electric company.
