Remington’s lawsuit stands

District Judge Jackie Glass on Wednesday refused to dismiss a lawsuit filed by fired Community College of Southern Nevada President Ron Remington.

Tom Ray, attorney for the University and Community College System of Nevada, had filed the motion asking Glass to toss out the lawsuit in which Remington claims he should be reinstated to his presidential post.

Remington and lobbyist John Cummings filed lawsuits against the Board of Regents after regents removed the pair from their positions after a 17-hour closed session Nov. 17 and 20.

Nevada Attorney General Brian Sandoval filed a similar suit seeking to void the demotions, saying the discussions leading up to the votes violated the state's open-meeting law. Those lawsuits have since been combined.

During Wednesday's hearing, which dealt only with Remington, Ray argued that there was no legal basis for the suit. He said the suit focused on three main issues: that Remington was entitled to be present at the meetings, that he was entitled to due process and that notice of the meeting should have been given according to state law.

Ray said the court already had ruled that Remington was not entitled to be present at the meetings and that he was not entitled to due process. As for the final issue, Ray said, notice of the time and place of the meetings were properly given.

After denying the motion for dismissal, Glass said Ray had 10 days to file an official response to Remington's claim. At that time, she said, the court could "begin addressing the issues alleged in the attorney general's complaint."

"I would like to stop dragging this out," the judge said.
