Supreme Court denies rehearing in Mosley case

CARSON CITY -- The Nevada Supreme Court has denied a petition for a rehearing in the case in which Terry Mosley has battled District Judge Donald Mosley for custody of their 11-year-old son.
Terry Mosley had sought a writ to disqualify District Judge Robert Estes in the custody hearing in Las Vegas. But the court said, "It appears from the documents before this court that Ms. Mosley has been granted the relief she was seeking in the district court, as that court has awarded her joint legal and physical custody of the child."
Terry has waged a legal battle for more than five years to gain sole custody of the child.
In her rehearing petition, Terry suggests that Judge Mosley is not complying with Estes' order. The court said Monday that issue of enforcing the Estes order is not before the court.
The petition said if Mosley does not comply with the District Court order, then Terry Mosley must apply to Estes to enforce it.
