County-city zoning feud will be revisited

Flashpoints of recent Clark County Commission land use decisions will be back on the commission's agenda Wednesday -- including a controversial decision that highlighted disagreements between the city of Las Vegas and the county.

A commercial zoning application for 2.5 acres at the northeast corner of Cheyenne Avenue and Campbell Road was opposed by nearby residents and the city, but was approved by the county Dec. 20.

The County Commission on Jan. 17 voted to reconsider the approval for the 30-foot-high shopping center. Supporting reconsideration was Commissioner Chip Maxfield, who in January replaced Lance Malone as the commission representative for the district.

Malone had supported commercial zoning for the site.

Las Vegas city planners joined county planners in asking for a denial of the application, since it does not meet either the city or county land use plans for the area.

Another controversial issue near city-county jurisdiction lines will be up for reconsideration Wednesday, this one on the south side of Sahara Avenue at Tioga Way. County commissioners in July approved zoning to allow a 10-acre car sales operation at the site over the protests of nearby residents and a recommendation to deny the permit from county planning staff.

District Judge David Cherry sent the zoning approval back to the commission, asking for clarification on thorny issues involving state law. The area may be within a Rural Neighborhood Preservation area, which by state law would prohibit intensive commercial uses.

Cherry said commissioners need to identify whether the car lot is within a preservation zone buffer area and define how a car lot would serve as a buffer.
