Motion seeks dismissal of sex case against ex-cop

An attorney for a former cop accused of using his badge to coerce sex from prostitutes filed a motion in District Court today asking for the case to be dismissed for lack of evidence.

"There is no evidence that will allow a conviction," attorney Clarence Gamble said.

Arthur Sewall, 30, was arrested in early February 1997 after a 36-year-old woman told police he threatened her with arrest if she did not perform a sexual act.

"We believe there is no evidence that this was without the consent of these prostitutes," Gamble said.

Metro's vice unit and Internal Affairs Bureau had set up a videotaped sting operation at the Del Mar Motel at 1411 Las Vegas Blvd. South. The tape showed Sewall agreeing to have sex in exchange for not arresting the woman on a drug charge.

Sewall was released on bail, but arrested again after another woman came forward with a similar story.

Sewall, who resigned from Metro last year, pleaded innocent to two counts of kidnapping, three counts of sexual assault and three counts of oppression under the color of office.

His trial is scheduled for June 9.

A plea bargain was offered by the district attorney's office this week, but Sewall turned it down, Gamble said.
