Arthur Sewall, 30, was arrested in early February 1997 after a 36-year-old woman told police he threatened her with arrest if she did not perform a sexual act.
"We believe there is no evidence that this was without the consent of these prostitutes," attorney Clarence Gamble said.
Metro's vice unit and Internal Affairs Bureau set up a videotaped sting operation at the Del Mar Motel. The tape shows Sewall agreeing to have sex in exchange for not arresting the woman on a drug charge.
Sewall was released on bail but arrested again after another woman came forward with a similar story.
Sewall, who resigned from Metro last year, pleaded innocent to two counts of kidnapping, three counts of sexual assault and three counts of oppression under the color of office.
His trial is scheduled for June 9.
