Binion’s lawyer lashes out at board

The State Gaming Control Board has been using the media to "vilify" suspended Horseshoe executive Ted Binion, his lawyer has charged.

"It appears that the board has such a dislike of Mr. Binion that it can no longer exercise sound judgment in the administration of its affairs," attorney Richard Wright said Monday in papers filed with the Nevada Gaming Commission.

"This is evidenced by the fact the board or its agents have apparently leaked information from the supposedly confidential investigative hearings to the press. ..."

Wright is asking the Gaming Commission to force the Control Board to conduct Binion's April 9 deposition behind closed doors instead of in public as planned by the board.

The deposition is being taken in conjunction with an April 29 hearing before the commission on whether to ban Binion permanently from the Horseshoe because of continued drug use.

Wright suggested the board hasn't been playing by the rules and considers itself "above the law" in the Binion investigation.

"It appears that the board wants to try this case in the media rather than in front of the commission as the rules provide," Wright said.

He added that his client is entitled to a fair hearing, not a "media sideshow."

Gaming Commission Chairman Bill Curran said Monday he planned to issue a ruling this week on motions before the commission by Wright and the Control Board.
