EFCA co-sponsored by Obama eliminates private voting-a strategy to increase membership.Unions represent 15% of Nevada's workforce.Not for long!
140 million US workers will be denied their right to a federally supervised private-ballot election.Currently, workers decide to unionize by a private ballot election, voting anonymously, without fear of intimidation or reprisals. Under EFCA, union organizers only have to gather 50%+1 signed cards.They can be subjected to intimidation or coerced into signing authorization cards.
Workers votes are made public to the employer, union organizers and coworkers.There is no private ballot election or freedom of choice!
This runs counter to one of our country's greatest traditions--the right to vote by private ballot.
Senator George McGovern's warning, "Under EFCA, workers could lose the freedom to express their will in private, the right to make a decision without anyone peering over their shoulder, free from fear of reprisal. To my friends supporting EFCA I say this, We cannot be a party that strips working Americans of the right to a secret-ballot election. We are the party that has always defended the rights of the working class. To fail to ensure the right to vote free of intimidation and coercion from all sides would be a betrayal of what we have always championed."
Unions are not obliged to follow the same rules as industry. Union salespeople (called organizers) are under no legal obligation to be truthful when collecting signatures on union authorization cards.
Union organizers are not even required to notify all of the workers that they are forming a union. You or your co-workers can be misled into signing a union authorization card that enables a union to become your dues-collecting agent without you ever having voted for it.
Senator McGovern adds "there's nothing 'free' about the EFCA.Organized labor, along with the vast majority of Democrats in Congress, have made the so-called EFCA, or "card check" bill, a top priority and are persuading candidates to pledge their support.EFCA would give organized labor an unfair advantage in union organizing at the expense of both employees and employers. This proposed law can not be justified. Working families deserve a voice and a private vote because Democracy is something that should never be sacrificed."
Barack Obama's presidential campaign pledge brings clarity to this point, "it's time we had a president who didn't choke saying the word Union. We need a President who knows it's the Department of Labor and not the Department of Management. A President who strengthens our unions by letting them do what they do best, organizing our workers.We will pass the Employee Free Choice Act.It's not a matter of if, it's a matter of when.I will make it the law of the land when I am President."
Preserving a private-ballot election ensures all workers will have a voice, all votes will be counted, and every vote will count!
