OSHA will not say much about a chandelier falling on some guests at the Bellagio because OSHA jurisdiction is over the employer-employee relationship and not the general public. If employees were struck by the chandelier then OSHA would show interest.
Why has the Orleans incident not been included in these articles as this was the greatest travesty of law in Nevada OSHA history. As letjusticeprevail and kellysnow stated, several Willful violations were proposed for Boyd Gaming. This sudden "change of heart" to reduce everything to Serious citations was not a decision made by OSHA administrators alone. Meaning, CArson City had heavy involvement, from a powerpoint presentation with the Governor, to consultation with Business and Industry Director Mendy Elliot. Strangely, the inspector who performed the inspection was not allowed to attend these meetings. The inspectors Supervisor was forced to sign the report under duress and when he wrote "Do Not Agree" under his signature, administrators ordered it to be whited out. The glaring reason for the change from willful to serious is money. Boyd Gaming is not stupid and knows that Willful violations equate to negligence whereby essentially throwing out any Workers Compensation limits and leaving the families to sue for whatever sum they feel appropriate. With serious violations, then Boyd is shielded by Workers Comp and the families get a set sum, a small pittance I'm sure.
Only a small bit of checking would easily determine that the majority of those citations being thrown out lies on one persons' shoulders - The District Manager with some guidance from the Chief Administrative Officer and Counsel. The inspector is never allowed to attend. Only when the employer starts making a lot of points of contention are the inspectors allowed to participate. When the inspector enters the informal conference, it is that person against the entire room. The inspector is made to look as if he is idiotic or incompetent by his own administrators as well as the employer. Staff meetings are held where inspectors are told not to worry about what happens in the informal. Once the report is handed in, the inspector is to flush all memory out of his mind apparently. I could go on for hours.....
