New trial ordered for man convicted of killing toddler

CARSON CITY — A man convicted of killing a 2-year-old boy 17 years ago in Las Vegas must get a new trial or be set free, the U.S. Ninth Circuit Court of Appeals ruled today.

Kevin Camp is serving a life term for the beating death of Lamar Brooks Jr. in January 1998. He maintained someone else was responsible.

During the trial, the prosecution called a medical expert to testify without notifying the defense, according to court documents.

Camp’s defense was given only 24 hours to find an expert to challenge the prosecution witness, which it could not, according to documents.

The court said Camp’s due process rights were violated.

“The state was permitted a ‘fundamentally unfair’ advantage when it was allowed to present an unnoticed expert rebuttal witness,” the court ruled.

The Nevada Supreme Court had previously upheld the conviction.
