The 22-year-old driver accused of striking and killing a man trying to fix a flat tire on U.S. 95 has been arrested on charges of DUI involving death and failing to maintain a travel lane, according to Nevada Highway Patrol.

Initially, Highway Patrol thought the driver, Gary Richard Adair Jr., was suffering from a diabetic episode. Upon further investigation, it became clear Adair was impaired and that a medical issue did not play a role, said Highway Patrol Trooper Loy Hixson.

The deadly accident happened at 5:36 p.m. Monday in the southbound lanes of the highway near the Summerlin Parkway exit.

Kadar Brown, 38, of Las Vegas exited his white Ford Expedition, possibly to fix a flat tire, on the shoulder of the highway, Hixson said.

Adair’s Dodge Durango struck the Expedition and then hit Brown, who was pronounced dead en route to the hospital, Hixson said.
