Supreme Court: No suspensions for lawyers on first-time DUI offenses

CARSON CITY — The Nevada Supreme Court has ruled that a first-time conviction for drunk driving does not mean attorneys should automatically be suspended from practice and referred to the state Bar Association for discipline.

“The gravity of drinking and driving cannot be minimized; however, first-offense misdemeanor driving under the influence is not the type of offense for which professional discipline is typically imposed,” the court ruled.

The court said a first offense is not considered serious in regard to the rules requiring suspension and automatic referral to the disciplinary board.
