Are handbillers guilty of assault?

Regarding the issue of handbillers on the Strip:

If memory serves me correctly, the crime of assault and battery involves an approach and physical touching. If that is still the case, then the Clark County Commission should be able to craft an ordinance defining the uninvited approach of someone to another for commercial purposes as a misdemeanor assault.

By criminalizing that activity, the propensity of the handbillers to accost people in public areas should decrease, especially after the first or second arrest. I believe that a measure such as this, enforced equally against everyone who is engaged in that practice would be within the legislative rights of Clark County.
