Lawyer to get $100,000 for referring malpractice case

CARSON CITY — A Las Vegas attorney will get $100,000 for referring a medical malpractice case to another law firm in Southern Nevada, a federal appeals court has ruled.

The U.S Ninth Circuit Court of Appeals overturned a decision by Federal Judge Philip Pro, who decided twice that attorney Brian P. Fitzgerald should receive $33,333 for his work.

Fitzgerald referred a medical malpractice case that was eventually settled to attorney J.R. Crockett Jr., who received a $500,000 fee.

Fitzgerald maintained he had an agreement with Crockett for half the fee. But the District Court found there was no binding agreement.

Fitzgerald also said it was the custom for a referring attorney to receive a third of what was received.

Crockett, meanwhile, said Fitzgerald was entitled to be reimbursed only his hourly rate.
