The Nevada Supreme Court says it's not going to consider an appeal to remove Scott Ashjian's name from the U.S. Senate ballot.

The justices on Thursday unanimously rejected as moot an appeal by Independent American Party candidate Tim Fasano.

The court said those challenging Ashjian's qualifications as a Tea Party of Nevada candidate waited too long to seek an expedited high court hearing.

Conservative groups have opposed Ashjian because they fear he'll siphon votes from Republican nominee and national tea party favorite Sharron Angle in the race against Senate Democratic Majority Leader Harry Reid.

Thursday's order follows an Oct. 6 ruling that it was too late to declare Ashjian unqualified because ballots had already gone out to people living outside the state.
