Tea Party candidate a no-show at hearing to kick him off ballot

Scott Ashjian, the Tea Party of Nevada candidate for the U.S. Senate, failed to appear at a district court hearing today challenging his spot on the election ballot.

District Judge Todd Russell said he would give Ashjian "one more chance to show up." If he fails, the judge said, he was "inclined to grant the ex-parte motion" to strike Ashjian from the November ballot.

The suit to remove Ashjian was filed by Tim Fasano, the Independent American Party U.S. Senate candidate. Fasano, of Fernley, maintains Ashjian made a false statement when he filed for office.

The next hearing in the lawsuit was set for April 14.

Fasano's suit alleges Ashjian falsely claimed he was a member of the Tea Party of Nevada when he filed his declaration of candidacy on March 1 for the U.S. Senate. The suit includes a document that appears to show Ashjian did not change his voter registration until March 2 to the Tea Party.

On Wednesday, the state Contractors Board revoked the license of Ashjian, owner of A&A Asphalt Paving Co. He was also fined $1,500 and ordered to pay $1,148 to cover the cost of the investigation.

Ashjian, a licensed contractor since 1994, failed last November to furnish the board with a current financial statement as required by law. He was also accused of giving a bad check to pay $981 a supplier.
