Muslim group says Henderson police detained 7 praying men

The nation's largest Muslim advocacy organization has filed a complaint with Henderson police, saying seven Muslim men from southern California were detained and told they were acting suspiciously while praying in a shopping center parking lot.
The Council on American-Islamic Relations said Friday it filed the complaint this week against the Henderson Police Department because it did not understand what was suspicious about the men.
"Our main concern is the police department looking at praying and the way they looked as probable cause for investigating those men," said CAIR spokeswoman Munira Syeda. "They did nothing illegal."
Henderson police spokesman Todd Rasmussen said the complaint was received and internal affairs would investigate, but he declined comment on the incident.
Rasmussen said the department would inform the group of the outcome of its complaint, but said it did not have a timeline for an investigation.
The group says the men, whom it identified as being of various ethnic backgrounds including Middle Eastern and south Asian, were performing one of five required Muslim daily prayers in the lot while stopped to buy gas and food Dec. 20 during a roadtrip.
As they returned to their car, they were stopped by three officers and kept for about 40 minutes while three officers checked their backgrounds and searched their car, Syeda said.
Syeda said the men were not blocking traffic or preventing other cars from parking.
A CAIR attorney said in a statement that the group was seeking discipline against the officers involved, changes to officer training and compensation for the emotional distress of the men.
"The scope and length of the stop was not reasonable under the circumstances, nor did it serve any legitimate investigative purpose," CAIR lawyer Ameena Qazi wrote in a letter to Henderson police.

Who cares. Muslims have proved time and time again they are no friend of the United States. They are a terrorist organization and cannot be trusted.
I believe dropping down to pray in the parking lot of a shopping mall, a sports stadium, hotel lobby, etc. .... all qualifies as suspicious in my book.

I agree, dropping down to pray in a parking lot is BIZARRE, and given the past actions of the Muslim terrorists, the Henderson police department did exactly what they needed to do. If you dont think so then move to Iran.
I applaud Henderson Police for watching out for the public. With all that has happened with extreme Muslims, we all have to be on the lookout for some of these people. There's nothing wrong with what they did.
There was no harassment, no physical altercations, and they were only detained for 40 mins. If they had time to pray, they had time to get a background check.
Wearing pallazo pants, Sinbad pointed-toed shoes, sporting a Bin laden beard, and pointing to the East whilst shouting Arabic chants of Abra Kadabra in an Albertson's shopping center in Henderson, NV, USA, is highly suspicious.
Thank you Henderson police, for doing your job well. It is reasonable to question any large group loitering in a parking lot, particularly if those loitering are engaging in the rituals associated with a death cult.
It's amazing that the persons who have posted comments about muslims must have forgotten what the Bill of Rights (that's the first ten amendments to the US constitution, for those who forgot middle school government in here) guarantees.

The right to bear arms
Protections against unreasonable search and seizure
Due process, double jeopardy, self-incrimination
Trial by Jury, rights of the accused, right to legal counsel
excessive bail or cruel and unusual punishment
The above rights apply to everyone in the US (by the use of the word 'person' in the constitution, and not 'citizen' or 'lawful resident').

I say searching a group of men that have a known belief system that demands they kill every one who won't join them in their barbaric religion that are dropped down to the ground shouting Islamic chants in a parking lot is a VERY reasonable search!
If the police had ignored the situation after a complaint came in and something had happened- the outcry would have been heard across the world. In this day and time, if would be difficult not to profile, knowing this, why would this group bring attention to themselves unless it is to create an incident to cry prejudice. The police did the right thing.
I remember the time when the HPD officer shot the wife of the ice cream truck driver. The city of Henderson settled a lawsuit for 700,000 dollars when the officer who shot the wife was implicated in a inappropriate relation with a minor (which was probably the reason why the case was settled).
If you want to see a country with an oppressive government, try North Korea (they just executed a person for reporting news OUT of North Korea), they don't have a Bill of Rights as part of their constitution).

However when there is a male sitting in a car for 3 hours across from a school playground taking pictures... while none of those things are illegal, they are suspicious. Sorry ninjaman, but the bill of rights and the constitution do not apply to everyone in the US. The word "person" or "people" refer to US nationals and citizens. Most of those rights are inferred upon resident aliens and legal visitors, but illegal aliens/immigrants have no rights.

If these guys were using this 'praying' as a prelude to maybe blowing something up and it was known the cops were there and didn't do anything then you'd be on them for not checking them out.

They were detained for 40 minutes because they were conducting themselves in a manner that was odd. State law allows a 'Terry Stop' for 60 minutes. The police are paid to be suspicious.

If your contention is that the constitution doesn't apply to everyone within the confines of the United States, I would suggest you look at the USSC decision in 1982 (Plyler vs Texas) in which the court ruled 5-4 that the children of illegal immigrants who were brought into this country are entitled to a public education under the 14th amendment.
Also, take a look at the Ark decision in the late 1800's (this is the ruling which makes every kid born here, except those born to diplomats or their staff US citizens).
While I disagree with both of the above rulings, as a citizen, I have to abide by them (I don't like a lot of things happening in the United States these days), but give that the masses are being constantly dumbed down by our public education system, it's no wonder that many people have forgotten that THEY are the government, that rights are like muscles, you fail to exercise them, you'll lose them, before you even know that they are gone.
Remember Germany in World War II, imagine what the world would be like if they had won the war, instead of the allies...

I, if I were a policeman, would find praying in a Mall parking lot a suspicious act. After all don't the terrorists pray to Allah just before they commit their terrorists acts? And, there are thoughts that a Mall could be a future target for muslim extremeists. It's not a matter of bigotry, profiling or racism. it's a matter of protecting the public and preventing a disaster from happening.

Stopping them and asking what was up is completely different from detaining them for 40 minutes. It doesn't take 40 minutes to run your ID's. If you relate all muslims to the extremism practiced by few, you are indeed a bigot and should definitely go and see the world and expand your own.

The police acted correctly and professionally. They should be congratulated. No one was arrested, just detained and released when the police were satisfied nothing untoward was going on. If Christians were praying in the parking lot as a group the same way, the police would stop them as well for an explanation. Maybe not detain them, but Muslims have a history of terrorism. Christians do not. This is the real world. Their rights were NOT violated. If they don't want to be detained, don't pray in a parking lot, go to your mosque like most other religious people.

The 1st amendment protects the people from gov't intrusion of their right to speech and religion, correct? People have the right to free speech and religion in a variety of places -- such as gov't owned/maintained areas, houses of worship, private homes, etc.
So, how pray tell, does the 1st amendement apply here? This is a parking lot in a shopping center -- it's private property. The purpose of the shopping center is for business and commerce. Any other activities can be and should be prohibited by the owner.
The owner of the property has the right to and can prohibit any persons from using the property that causes a disruption to business or presents safety concern. Private security or the police have the right to stop or remove people who are using the parking lot for other reasons then business or commerce.
Does a group of people praying in shopping center parking lot possibly disrupt business? That argument could be made. Does a group of people praying in a parking lot present a safety concern? That argument could be made also. Do these people have the right (right meaning they are protected by the U.S. Constitution) to pray in this parking lot - NO!
To all you 1st amendement horn tooters think about this: Using your logic any religion or any group could simply go to any privately owned area that's open to the public and go about their business. Huh?
I challenge anyone to cite one precedent setting case from the U.S. Supreme Court that establishes the right of a person or persons to openly practice their religion in a privately owned public area.

You should read about Quasi-Public places. In Marsh v. Alabama, the Court held that the private owner could not forbid distribution of religious materials by a Jehovah's Witness on their property.

THE UPDATED BILL OF RIGHTS (TEABAGGERS' VERSION)
1st Amendment: Applies only to evangelical Christians.
2nd Amendment: The holiest of amendments, this right includes no restrictions whatsoever. So go buy yourself a full-auto AK-47, 'cause Thomas Jefferson would've wanted you to.
3rd Amendment: Prohibits quartering of troops on private property. I suspect this would be viewed as anti-military, so teabaggers probably hate it. Delete.
4th Amendment: Unreasonable search and seizure. If you haven't done anything, you should damn well let the cops and NSA look at whatever they want, you Commie. Delete.
5th Amendment: Protection against self-incrimination and double jeopardy. Anything that coddles criminals sucks. Delete.

Ok, it was a parking lot, used for parking, thus the name, PARKING lot. Trust me, go throw out a prayer rug and kneel in prayer for an extended period of time and someone is going to ask you what you are doing. I don't care if you are Muslim, Christian, Jewish, or Buddhist. Yes, I know Buddhist's don't pray per se they meditate, whatever. Getting someone's ID and running them for Wants and Warrants is standard stuff. How many times have the police been lambasted for doing a traffic stop on a wanted person and then letting them go because they didn't follow procedure, only for that person to commit another crime later.
If I say a brief prayer before I eat at a restaurant, that sort of thing is acceptable as long as it's not a long drawn out disruptive thing, in which case I would expect to be thrown out on my butt. Whats not suspicious to them in their country may be suspicious in ours. Perhaps if they want to pray the way they do in their country they should remain there or be subjected to questioning by the Henderson Police or any law enforcement agency.

I am troubled by the comments I have read here. It is apparent that no matter what the topic is someone can and always will turn it into something racial. Freedom of religion is in fact a right we all have. However this whole incident is not about religion or race or individual rights nor is it isolated. I think the time has come for a second constitution convention. The current bill of rights has been bastardized by 200+ years of dissecting and defining what they think the meaning to be. Norway, Sweden and Denmark qualify. What do you suggest?

You do have a right to refuse to answer any questions or make any statements. That refusal to dispel my belief that a crime is or about to be committed may take it to the next level. I am not saying that praying is against the law (at least not yet, unless you are in a public school) all I am saying is seeing a group of people bent over in a public parking lot supposedly praying, I am going to ask questions I don't care who you are or who you know. There is no law that states a police officer can not come up to some one and start a conversation. The men mentioned above did not have to allow any search to their vehicle especially if there is nothing in plain sight, all they had to say is NO.
Again detaining the men for 40 minutes is not an unusual amount time time. As long as they were not under arrest, they could have walked away at anytime they wanted to.

It wasn't private property, in the way you mean. These men were CUSTOMERS, and had every right to be there. I don't see anything saying they were denied service, or asked to leave by the property owner, or an agent thereof.
The problem with prayer in school, is that before that football game, you'd have to allow ALL of the students to pray in the manner of their religion. Your Christmas pagent would need the addition of Ramadan, Channuka, Kwanzaa, and the Winter Solstice- to name a few.
You'd be ticked as all get-out, if there was only one prayer offered, and it was a Muslim one. Why should a Muslim kid have to pray to Jebus? Taking 'God' off money etc is because some people are athiests, and some 'trust' in Allah, Bhudda, or aliens- and it's their money/government, as well as yours.
And yes- the ACLU would 'allow' Christians to pray. They are there to defend ANYONE who has their civil rights violated.

Another thing. A few years back I was a witness to an accident. I stayed to make sure everyone was ok and to be a witness to the police. The first thing that they did was run my license to see if I had any warrants or whatever. I am not Muslim, South Asian. While I deeply appreciate the decent sentiments displayed by many of todays posters, particularly the one by DesertVixen, they tend to show a naivete when dealing with THIS particular issue.
Militant Islam is not just a religious movement, it is a political one as well and is causing military strife in dozens of locations around the world. In fact these bloody confrontations seem to be in any area where Islam interfaces "infidel" societies. Of coure, we know about Israel and India, but add in Russia (Chechnya et al), China (Urghars), Philipines, Thailand, Maylasia, Nigeria, Darfur, Bosnia, Kashmir, the list goes on and on.
As fair minded people, we have been taught that pre-judgement is tantamount to bigotry and is a bad practice.
Problem here is that that Al Qaeda and its many recombinant forms are like the KKK, you can't tell who they are until their hoods are removed. To this problem, add the fact that 'mainstream' Islam has been slow to distance themselves from the 'bad guys'. Now add in the revelations that have occured since 9/11 that perhaps their religious texts are open to violent interperatations.
Now we all know that Western history is filled with all kinds of religious horror stories. But we as a (Western) society have grown from these atrocoities and consequently are more able to recognize the threats from religious lunatics as a result of our combined experiences.
So, while we are at war, and while we can't tell the bad guys from the good guys, lets let our law enforcemnt folks err on the side of prudence.

If I saw a group of Christians (I'm one) praying in a strip mall's parking lot, I'd find that a bit odd too. It would be reasonable for police to ask them why they were praying in a parking lot.
Also, the men in this situation weren't arrested by Henderson Police. In this case, "detained" meant "you have to wait here with us until we know what's going on." It took 40 minutes. Then they were free to go.
It's a fine line, sticky situation, or whatever you want to call it. But I vote that the Henderson Police handled this one the right way.
If I see people dropping down to pray and chant in public I will be RUNNING away. Sorry. Stereotypes exist for a real reason. If that makes me a racist, well, I'd rather be a LIVING racist.

I can't believe I'm even putting another comment on this subject...like its really going to change anything but the last thing I would be interested in interjecting on this subject is, all one has to do is log onto www.brusselsjournal.com and observe what Western Europe is, and has been experiencing with issues just like this for quite some time now.
I would guess that The US is probably approx. 7-11 years behind whats going on over there with mass immigration, from the Netherlands to Sweden to the United Kingdom. Its like the pot is getting to boil over there, its not a matter of if, but more like when....
One example would be that in the City of Marselles, France there exists approx. 72 "no go zones" which are Project and ghetto style neighborhoods that the police and related authorities aren't allowed to enter if something occurs that requires they're presence, because a "Sharia" authority is in place in that City which gives Islamic officials authority to conduct Court and issue punishment independent of the laws in place covering the rest of the Common Wealth of France because the majority of the people living in those neighborhoods are of foreign decent and/or Muslim based origins...just for one example..

If death was so highly prized, you'd never see agony on the face of a Muslim parent, upon learning of the senseless death of their child.
It is in ALL religions, to believe that leading a just life, and performing your religious duty will secure you a place in Heaven. If you TRULY believe that, it is better to sacrifice your own life, than to accept another's religion. It's not just the Islamic faction that teaches martyrdom, Christians and Jews do it as well.
Shari'a is a way of life, following their religious beliefs and laws based upon those beliefs. So, it works pretty well for them. Just like not using electricity works for the Amish.

In our criminal justice system, people are SUPPOSED to be innocent, until proven guilty. The answer is not to condemn everyone equally, but I am not sure what the solution will be. There are suggestions on the table, but it's going to come down to how many of our civil rights we AMERICANS are comfortable losing, in an effort to stop terrorism.
everyone has a different opinion on this subject, truth is that Muslims have given themself a bad name and people will view them according to the action some Muslims have taken(terrorism) so its not surprising that the HPD (or any other person) would view the act of praying in a parking lot suspicious, especially if they are middle eastern or from any group assosciated w/ terrorism... Im not saying what the police did was totally right, but it wasnt totally wrong

The police were responding to a call from a citizen reporting suspicious behvior & they responded. They absolutely did the right thing. Well done!

Truth of the matter is this Islamic cult movement has sucked more people into its belief system after 9-11 than ever before in the history of this Country, this would be inclusive of many,many, dis-enchanted white folks for whatever reason, ALL races of folks in the prison system; mainly African American though, and alot of people that find mainstream Christianity and Judaism to be way too diverse to follow which (in my opinion) is a major failing for the Christian religion, too many people, too many opinions on the subject,from Catholic-ism to Orthodox Christianity to Mormon-ism to Scientology to New Age etc.,etc., Where to begin? And then you toss in people loosing faith in the Governments responsibility to do right by all different standards of how people see things as doing the right thing? Prayer is 'protected speech'. Meetings are 'protected ACTIONS'. (Provided that it was a PEACEFUL and lawful meeting, rather than a planning session to commit a hate crime.)
Both fall under the 1st Amendment.
I would hope HPD, LVMPD, NLVPD or any agency would make contact with any group "praying" in an unusual place to find out what exactly was happening. If a member of the general public called in the potential suspicious behavior, the local jurisdiction has a duty to investigate. Not being on the scene, there could have been a language barrier or other reasons the stop took 40 minutes (which is well within the law as the men were not held for longer than an hour). So the libs need to quit b*tching and let the police work in accord to there lawful duty. As far as CAIR, will anyone disagree that they are an anti-America and non muslim hating orginazation whose goal is to see the west (America) taken over. If it was any other orginazation that was questioned, we, the public would never hear about it, but because it was a Muslim group, all of a sudden it's a crime (sarcastically) against humanity.
Ok Vegas Vixen, so I gather from your posts that if that certain time comes along the Muslim faithful must drop down and pray right where they are. So what if you have a group of Muslims crossing Las Vegas Blvd. when that time comes? Can they finish crossing the street, or should METRO just re-route traffic around them while they practice their religious freedom? And if they can finish walking across the street, why couldn't these guys take a minute to find a more appropriate place to pray? Again I go back to my statement it is a parking lot. Parking lots are for parking. If I went into the store bought 50 pounds of hamburger and then decided to have a barbecue in the parking lot, I would hope someone would say something to me.
