North Las Vegas officials were notified Wednesday afternoon that a domestic battery charge against a police officer was dropped by the District Attorney’s Office.
Metro Police arrested North Las Vegas Officer Toby Winn, 34, after his girlfriend reported to police that he grabbed her by the arm, shook her and threw her to the ground while trying to exit a car about 6 p.m. Monday at the Sahara hotel-casino.
According to an arrest report, both were riding in a friend’s car when they began to argue over Winn’s ex-wife. The woman asked the driver to stop so she could get out of the car, police said.
The woman reported the alleged battery occurred when she was leaving the vehicle, the report said, but authorities learned Wednesday the District Attorney’s Office dropped the charges.
Winn has been a North Las Vegas officer since February 2009. He will remain on administrative duty while North Las Vegas Police conduct an investigation of the incident.

Yet another example of the abysmal failure of area police departments to screen out violent individuals with major psychological issues in their hiring process.
A simple misunderstanding. Nothing to see here.

Being a police officer you should understand that you're at risk on and off duty. Las Vegas is a different place... alcohol combined with multiple personalities is a bad mix.
Who hires a 22 year old man with an ex-wife to be a police officer?...seems unreasonable...

Although the accused was arrested while claiming to be under the influence of alcohol -- was this claim substantiated by the administration of a sobriety test following arrest?
If so, what were the results, if not, why wasn't testing administered to quantify the claim?

Being drunk isn't an issue or defense in any crime of violence against another individual. It only is relevant in traffic violations, i.e. DUI. No reason or obligation to test. In fact, if the reporting is accurate, the fool admitted he was drunk.
Typical Cop, Do as I say- not as I do. He will be on paid leave for a couple weeks, re-instated and elected senator by age 50 or get full disability benefits for sticking his foot in his mouth, of course he and his teammates will continue to be worse alchoholics than 70% of the people they arrest on alcho related charges. Go figure

Very typical, most cops are dysfunctional, picked on as a kid, or in High school and want to "get even" for the rejection they experienced. Then they join the "force" to push people around.
The Sahara is not that far from where the "mysterious" shots that were supposedly fired yesterday.
We now have a full scale "police riot."
Cops and booze don't mix. Cops already have an attitude. Throw in the booze, say the wrong thing and the abuse starts. Most have very short fuses. Not to make excuses, a lot don't leave the job behind when they go home at night. They continue the attitude off duty. This is very common in ANY city in the country not just Vegas.

It is all a big mistake. The cop was so drunk that he thought that his girlfriend was Joe Citizen, so he whacked her a few times. These things happen.
I am sure he never lost his temper on the job
Just another bad apple, Yeah Right! It's no wonder that more and more people are losing respect of the police.
And NO, he should not just be fired, he should also be charged with domestic violence which should remain over his head for the rest of HIS LIFE just like anyone else going through the process.
The police leadership for NLV and LVMPD need to be replaced ASAP.

This guy will be in the spotlight again someday, except with much worse charges, unfortunately.
The RJ version says she recanted. So two people got in a fight, she accused him of assault and then she changed her mind. The DA can't do much about that.
Well the other passengers in the car must of gave the real story to the police. The girlfriend must of fabricated alot of the story. DA's and the NLVPD will hang one if their own out to dry if they actually did something remotely close to what she was saying.

Charges are dropped in these cases all the time by the DA. Police are pretty much forced to arrest in any domestic violence case where there is evidence of any physical contact, even if it only amounts to a shove and the victim doesn't want to prosecute. Once it gets to the DA, they can drop charges if they so choose. The police don't have that option with domestic violence cases.
The final verdict is that SHE was shaking HIS arm with her neck...

You mean domestic violence cases involving the police are dropped all the time. I agree, and how sad is that. Police should not be above the law and should be treated harsher then Joe Citizen when they are caught breaking it, especially considering that they are both armed and an authority figure.
I don't think this clown being a cop has anything to do with squat!! If you haven't shared your house with a cackling idiot that won't shut up and always pushed your buttons, you should shut your cakehole! If he did this then he's in a tight spot for sure because of the double jeopardy. He doesn't have to be charged to still lose his job and like a fireman or any other front line public servant, it pays good enough and is hard enough to get that the copper would probably prefer time in jail to the loss of his career.
Article says she recanted her story as well. Wouldn't be the first time some girlfriend / boyfriend or wife / husband tried to get their copper spouse in trouble with their department out of spite.
Sounds like a bunch of the people who posted here just don't like the Police. Any profession with that many members is going to have bad apples and some good apples that as human beings, just have bad days or make a bad decision. Crooked cops are hated by good cops even more than by the public.

Informant23 - Unless they have changed a state statute in place since the 1980's, the prosecution of domestic violence is a mandated action by the DA. The law was enacted because too may victims were intimidated into dropping charges after the perpetrator was released and they were not prosecuted.
In this case, if there were evidence of domestic violence then the DA would have had no alternative but to prosecute, regardless of the victims recanting of charges.
One could then logically conclude that there was conflicting testimony by the other person present. The police followed through with their duty to report however;
Without any physical evidence (red marks, bruises, blood, etc) of the alleged battery present, the charges are nothing more than allegations (a common tactice used by the rationally impaired) made by one drunk against another.
In this case, a drunk girlfriend who is jealous of an ex-wife, who in her intoxicated state was unable to control her hystrionic behavior (drama), and a drunk boyfriend who's intoxication impaired his ability to control his anger (got sick of hearing it).
As for all the rest of the judgmental posts out there, use a little common sense and try to see the humanity we all share in this, rather than judge others based upon personal opinions and the stereotyping of others. All too easily you might just expose yourselves as little better than the two involved in the story.

This is true. Being in a position of public service and scrutiny is a responsibility not to be taken lightly; yet the wisdom of knowing to conduct oneself acordingly and avoid appearances of impropriety seems lost on too many in the position.
That being said however; you cannot bequeath unto your children that which you do not have.
Just look at our government and one can see, sadly, the behavior that is modeled from the top down. When your leadership is corrupt, it cannot produce integrity in the society it governs, and the result of their behaviors is being reflected in our society every day.
If Lindsay Lohan can get a slap on the wrist for DUIs and probabtion violation, and this guy can get away with roughing up his girlfriend. That means I can too right? Oh yeah, but I forget some people are above the law. Lucky for them.
Looks like this guy has 152 friends on Facebook. That's more than I have; I guess he's a better guy.
