Gov. Jim Gibbons plans to have Nevada join a lawsuit in Florida over the federal health care reform law.
Sun columnist Jon Ralston reported late this morning that Gibbons will say a Nevada statute prohibiting him from taking action doesn't apply if the state joins the lawsuit filed in Florida.
Ralston said the official announcement was expected to be made Tuesday.
Earlier this week, Attorney General Catherine Cortez Masto rejected the request of Gibbons to file suit with other states challenging the constitutionality of the health reform bill signed by the president.
In a letter to the governor, she said the “authority given to Congress is extensive and appears strong enough to support the act.”
“In my professional judgment, joining the litigation filed by 14 other states, as you have suggested, is not warranted by existing law at this time,” she wrote.
The governor responded saying he was considering his options to move forward with legal action on behalf of the state.
“I am disappointed the attorney general has refused to fight for the rights of Nevada citizens,” Gibbons said in a statement. “I swore an oath to protect Nevada citizens and that is exactly what I intend to do.”
Gibbons said attorneys have contacted the his office willing to represent Nevada without charge.

Gibbons sucks. He does not understand the common person. Elitist that only cares about the top 2% like the rest of the GOP.

I just love it how politicans act when the tables are turned against them. Everyone knows that if it was the other way around and Gibbon's didn't want something done and someone else went around him finding some loophole to get around his power he would be up in arms about it. He's doing the same thing here because he is one big cry baby.
The state of Nevada has been in economic freefall for four years. That jackass, Gibbons has done nothing but collect a paycheck and fiddle while the state burns.
Now he pulls this political stunt that will not only not prevail in a court of law, but is against the best interests of the people of Nevada.
What next?
This is another reminder the GOP only cares about two things (1) transferring wealth from what's left of the middle class to the rich (2) finding a way to interject they myth of Jesus into everything (but sill finding time to use donor money to hit the bondage club).

This is a blatant policatal move with no value to the citizens of Nevada. Very disappointing. Every legal expert has stated that the States have NO legal footing here. The Congress has the right to tax, and that is what they did. Everyone is subject to the tax, and if you have healthcare coverage then you get a deduction (just like your mortgage interest).
The ironic twist is this law was proposed by Bob Dole and rest of the republicans back in 1993-4.

However, the people that find it acceptable to have 5 kids with 5 different fathers, collect 52 weeks of unemployment without bothering to look for a job,

We could end up paying legal fees for people denied the benefits of the health care reform bill. e.g. uninsured children
Unless the Attorney General is legally disqualified (and no, declining to take the case does not meet the definition of "disqualified" within the law), they are the ONLY entity authorized to represent the State of Nevada in a federal court of law. Doesn't matter if that court is in Miami, Chicago, San Francisco, or Reno.
Why wait until the next election? Can't he be impeached? Whether you love or hate the Healthcare bill, this is a HUGE WASTE of resource. There's no hurry. The individual mandate doesn't kick in until 2013. That's plenty of time to see how Flordia's litigation goes. If they win, there's no need to file. If they lose, there's no reason to chase losing arguments.
Pandering to the Te@baggers because is has to election funds. Gibbons has to rely on whatever free press he can stir up.
And when Gibbons leaves office he will have government provided health care.

Except to follow state law she'd have to break her oath as an officer of the court (Rule 3.1 of the Nevada Rules of Professional Conduct states that an attorney must only bring meritorious claims before a court) and the Federal Rules of Civil Procedure (Rule 11 states that an attorney must assert that a case being filed is not being filed for an improper purpose).
She laid out her reasons as to why she believed that the case the governor was ordering was not meritorious, and that filing it would be improper under the FRCP.
So tell me - she can follow state law, she can follow her oath as an attorney before the Bar, or she can follow the Federal Rules (which have the effect of law). She cannot do all three. What should she have done?

I see it as the federal government giving me the right to choose. I'll get a choice of insurance policies from various insurance companies at a price my middle-class existence can afford.
I agree that this takes away your choice to not be insured, rack up huge medical bills, and then declare bankruptcy. It takes away your choice to force the rest of us to pay for your lack of insurance by paying higher insurance premiums and fees to cover all the people who currently don't have insurance and default on medical bills.

If he wants to stand up for me, he can start by bringing new jobs and industries to this state. That's part of his job. You can't on the one hand say "keep the Feds out of our lives" and then turn around and criticize the Feds for not creating jobs. If you don't want them, then YOU create the jobs; act like an independent if that's what you want to purport to be.
All that's needed is ONE state to file a lawsuit. It either wins or loses on the basis of legal principles. The precedent will apply to all.

If I have to explain what freedom they are taking, you will never understand it. What you're describing advocates opening up state borders for more competition. I agree, right now the government (states) have a strangle hold on who they allow to sell insurance in their states, which allows the market monopolies. Wouldn't the answer be to open the borders and let the consumer decide?

Please enlighten me. I did read the part about establishing a ready reserve corps (Section 5210). It's projected to cost 87.5 million for five years. Not quite sure how that relates to health care.
how is this bill going to prevent bankruptcies? families still go bankrupt with health insurance (i.e. health insurance doesn't cover everything). the bill only forces you to get health insurance, that doesn't mean health insurance will all of a sudden cover everything magically. You get some major sickness, etc? this still isn't going to prevent bankruptcies anymore than before the bill was passed.

what makes you think premiums will go down? all the uninsured paying insurance? most of that money is going to help pay for the people they would otherwise not cover. there is no real mechanism to force lower premiums. What, we are paying less by getting help with subsidies? in the end, insurance companies are getting the same amount of money, little from you, rest from the government.
health insurance got a bailout, and a guaranteed 25+ million new customers. what incentive do they have to lower premiums? lol

...but the suit brought by the other 14 state AG's does contain a meritorious claim and is being filed for a proper purpose. You and I both realize this is all politics; she's a Dem and the governor is GOP; this works out better for all of us anyway; we, the citizens of NV, don't want a Dem AG joining this suit in a half-assed manner; now the governor can get a real attorney to jojn with the other 14 AG's and fight this unconstitutional law.

By my count, there are 18 attorney generals that are republican, and not even all of them agree there is a case to be made.

Exactly how has "tort reform" in Nevada helped us? Our insurance rates are among the highest in the nation, we have among the lowest doctor/people ratio in the country. You would think that doctors would be flocking to Nevada. Oh yes what's his name of the Hepatitis-C scandal set up a business here. And, after 2 1/2 years not a lawsuit. He was well-protected.
BarryS, I think they should change the cap on tort reform to unlimited, but they also need loser pays. This will cause the frivolous lawsuits to stop because attorneys wouldn't be able to get their costs covered if their clients lose, while at the same time allowing litigation for legit cases.
Axiom, there are two problems I have with the proposal.
1. Those who don't get health insurance get fined.
I'm one for "accountability". If I feel like I have enough cash to pay as I go for medical care, it should be my right. I don't however have any specific right to demand that a hospital admit or treat me and expect zero payment. Ideally, that should be the only penalty incurred for not having insurance, the risk that a hospital will tell you to go to hell if you can't pay them.
2. We already have welfare, food stamps, section 8 housing, and a host of other programs already designed to help the numerous non-productive members of our society continue to bleed the middle class dry. Again, at some point there has to be accountability. We are creating a sub-society of people that spend their entire lives milking the taxpayers dry and contribute nothing in return.
Wow a lot of anger going on here. And quite a few threats being thrown around.
Gibbons is suing on two points.
One is that Obama/Reid/Titus/Berkley want to force you to buy a product against your will.
Second is that Obama/Reid/Titus/Berkley want the state of Nevada starting a few years from now to spend over $600 million (will go over a billion a year in about 6 years) a year to fund ObamaCare and therefore will cut and squeeze out money that normally would be going to fund k-12 schools, higher ed and public safety.
Keep up the good work Gibbons.

Probably equating basic health care with government tyranny is a stretch. What will be interesting to see is the actual effect on the national deficit as projected by the White House.
They have a good argument but only time will tell. States rights lawsuits will also be a good thing. Remember the result when slavery was at issue. Perhaps this is not so different.

Our govenor really looks pretty stressed out. I mean dispite all the political conflict he really needs to cheer up. In terms of outings to attend OK so he did not show at ye old tea party but he should make a point of going to Nevadas biggest yearly gathering: Burning Man. If the Gov. would go to this National Event in the Nevada Desert I am sure he would return to the drudge of the political fight with a new vigor and view on society and the political notions of those whom he is paid to serve. I have a feeling he would really enjoy the event.

They think they can win the lawsuits, and then they can work toward repealing the other provisions of the bill.
Again, we are talking the practical effects of the legislation being adjudicated. If sections are declared unconstitutional, they will use that as an excuse to repeal the entire legislation, returning us to the days of the insurance companies revoking insurance policies once someone gets sick.
Again, the lawsuits are based on state soverignty, and the states are arguing that the federal government doesn't have the right to dictate these policies. Take a look at the Virginia suit. You obviously haven't done your homework.

Seriously, if enough funding exists to sue the Federal Government over healthcare, I feel such money would be more wisely appropriated to Education: improving Nevada's education system is much more important (virtuous) than one's political position on healthcare reform. I would kindly ask our current Governor how much it would cost to sue the Federal Government to changes in healthcare reform. I think our current state executive leadership is living in the past. Changes are coming to improve the quality of live for many Americans who are uninsured or underinsured. Healthcare reform has been a platform for Democrats for many years. It's quite knobble to ensure all Americans have adequate access to healthcare (including mental health). It's absurd to sue against the will of the majority who seek changes to our current approach to medicine. Furthermore, our current Governor has mentioned that we might need to change and that change will be difficult for some people in this state; changes in healthcare will be difficult for the Governor.
Because lawyers are offering pro-bono free labor work then the lawsuit will not cost the state as much as normally it would.
On the other hand, if the lawsuit is not successful and if the parts of the ObamaCare are not repealed then that means in a few years that the state of Nevada will have to fork out over $600 million a year to fund ObamaCare and that number will quickly rise to over a billion a year.
So just think about what that cost will do to squeeze out money that normally be going to education budgets in Nevada.
That will be $600 million a year that could be going to education but not be going to ObamaCare.
If you are a teacher or a professor in Nevada then you should be fighting tooth and nail against ObamaCare and you should screaming to get people behind the lawsuit.

...I agree and I hope you're right, but of course repeal can't happen until we get BHO out in 2013(overriding the veto with 2/3's vote is not pragmatic and I'm nothing if not pragmatic).
But de-funding the current bill is possible if we control the congress after the mid-term elections, and that is indeed possible.

If Nevada has no unique interest, then why should we get involved? Even if it's a pro bono attorney, there will still be some expenses. Right now, we ride for free.

The more states that join the lawsuit then that will bring more weight to bare on the case before the courts.
That is why it is important to get as many states as possible to file suits.

...both Sgt Rock and myself have both posted that this bill will NOT be repealed unless and until BHO is out of office. But if he is, and if the Reps control congress, repeal becomes very much in play. What part of that do you not understand?

And how do I know your getting played? Because this is EXACTLY what Republicans did on the abortion issue. Every year they campaigned on getting enough Republicans elected to push new laws through Congress restricting or outlawing abortion. And yet, when they controlled the House, Senate and Presidency from 2001-2006 they did NOTHING about it because it's too good a "get out the vote" device.

They did not fund the program for the entire 100 years or even 2 years or even 1 year.
So each year, Congress will have to pass budgets to fund ObamaCare.
The House or the Senate can just choose not to pass budgets that contain funding for ObamaCare and their is nothing that the other chamber or President can do about it.

So to all of the leeches and the leech-friendly posters that are trying to get everyone else to subsidize health care for drug addicts, fat people, smokers, alcoholics, and people that reproduce like jack rabbits - please quit pretending that you are concerned about the state of Nevada's financial prudence.

They can't represent Nevada - only the Attorney General can unless she is legally disqualified.
She has declined to take the case, which is not a disqualifying action.
She has not been legally disqualified, so they can't do it, free or not. End of sentence. End of argument.

The new 2010 Obama Administration healthcare plan is unconstitutional. Why? In essence, it violates the 13th Amendment of the U.S. Constitution and the "involuntary servitude" clause by in most cases requiring / forcing individuals to work in order to pay for their own health insurance, which has now become a mandatory form of debt imposed by the U.S. Government. Furthermore, it may also violate the 4th amendment in that by being forced to pay a healthcare premium or a fine for not having healthcare, an individual's personal property (i.e., money) is now being confiscated to satisfy a debt that has been legislated into existence and signed into law at the expense of the 13th Amendment.
