New census query on immigration status would diminish state’s clout

Two GOP senators introduce amendment to keep illegal immigrants out of the count

Sen. David Vitter, R-La., and Sen. Robert Bennett, R-Utah, tacked an amendment onto an appropriations bill this month that, if passed, would greatly affect Nevada because of its relatively large Hispanic population.

The amendment would add an 11th question to next spring’s census, a question about “citizenship and immigration status.”

The two senators are trying to ensure that people who aren’t citizens are excluded from figures used for allocating congressional seats, a process that occurs every 10 years, after the census.

Nevada’s growth over the past decade would almost certainly result in the state’s gaining at least one representative in Congress. That growth includes 230,000 illegal immigrants, giving the state the 13th-largest such population in the nation, according to a 2008 Pew Hispanic Center estimate.

Two of the most visible opponents of the amendment are Southern Nevadans in and out of Congress — Senate Majority Leader Harry Reid and Andres Ramirez, senior vice president of NDN, a Washington, D.C., think tank and advocacy group.

Reid tried to use a parliamentary procedure Oct. 13 to prevent the Senate from voting on the measure, but fell short on support.

Rebecca Fisher, spokeswoman for Republican Sen. John Ensign, said the senator has no position on the amendment.

Reid’s spokesman, Jon Summers, said the amendment is “a partisan tactic designed to delay the passage of an important bill.”

Vitter countered on a conservative radio talk show that Reid “wants illegals counted in the census, wants illegals (counted) in the reapportionment of the House,” according to the The Hill, a Beltway publication.

Meanwhile, Ramirez held a news conference Tuesday of 10 national groups opposed to the amendment, including the Hispanic National Bar Association and the NAACP.

In an interview afterward, Ramirez said the Constitution and Supreme Court decisions make clear that congressional seats must be based on a state’s population. He noted that such a question could cause illegal immigrants and their family members to avoid participating in the census for fear that information about them would reach other government agencies.

The result would be an undercount, which not only affects future political representation, but federal funding for roads, schools and other public expenditures, not to mention private sector planning.

An undercount would affect Nevada in particular because a quarter of the state’s population is Hispanic, said David Byerman, Nevada’s chief representative for the Census Bureau. Nevada also has hundreds of thousands of people in so-called mixed-status families, meaning some of their relatives are in the country legally and others aren’t.

But Nevada and other states with large Hispanic populations may wind up not being hurt by the Vitter-Bennett amendment because “it’s too late to shift gears,” Byerman said.

Two congressionally mandated deadlines have come and gone — April 1, 2007, when the agency outlined what subjects the census would cover, and the same date a year later, when the agency released the survey’s 10 questions. “We met both deadlines,” Byerman said.

And the feds have printed 300 million forms. So printing new ones, not to mention reprogramming computers and retraining staff, would cost hundreds of millions of dollars, Byerman said.

Even if Congress wanted to spend additional money, the result would be “the failure of our operation,” he said. “We could not meet statutory deadlines.” One of those is Dec. 31, 2010, the date by which the agency has to submit data to the White House.

To achieve this, the agency needs to get its initial mailing out in late March, followed by a second mailing a month later and door-to-door visits starting May 1, lasting up to eight weeks.

Ramirez noted that census-takers in Nevada have another reason “to be ready to start on time” — higher-than-normal transiency rates as a result of tops-in-the-nation foreclosure rates.

    And we wonder why Nevada is broke, let's be honest, why America is broke. When the tax system was developed and annual budgets are established it is based on Revenue. Revenue and cost are working and cost to us taxpayers is far exceeding the revenue.

    The incremental differences between the two has been slowly creeping upon America over the years that it has finally exceeded the tax system. The only way to reverse this is to deport the illegals and stop allowing them the freebies.

    For those who don't want to deport then we need to develop an opt in and opt out tax system, this would be based on your voting so the cheaters pay their portion. If you vote against deporting then you'd be automatically opted in and your taxes would be raised to an amount that pays for illegal's to stay in the system and for those who say deport them, you'd be opted out and your taxes would be less. LOL, this would not last long, they'd be deported in a few years since it costs those who support them directly.

    We have 180,000 on unemployment insurance here and more than likely we have 250,000 unemployed and we have 230,000 illegal's here, do the math. And you want Reid to stay in office, you're the problem. America can't afford this anymore, if you want them here, you pay for them. Better yet, the DNC can write the checks and let the ones who support the illegals, they can pay.

    Fellow Nevadans who don't support Reid need to unite and fight for our rights. The Democrats continue to erode America's values and are destroying us from within and have one goal, codependence on the government and one nation world. If we allow them to continue like they have over the past 15 years it won't be much longer and we'll become another 3rd world country.

    Anyways, illegals have been counted in the census forever. The census doesn't care about their immigration status, it just wants a headcount and basic demographic data. If you start to ask questions about if they're here illegally, guess what, they aren't going to fill out the forms and send them in! You're just making the census bureau's job much harder.

    A census is to determine the number of people living in the US. Whether they're here legally, illegally, on a H1B work visa, whatever. Everyone uses the public road infrastructure to get places, everyone uses police and fire protection, etc. So in order to appropriately dish out the dollars, we need to know the total number of people living here regardless of citizenship status.

    And there is the problem. The present tax system doesn't account for the influx of illegal immigrants for any public body to support. If we continue to provide money to the states for their police, fire, roads, infrastructures, and healthcare system based on headcount regardless of immigration status, we'll be broke forever.

    When our forefathers setup the census up they never imagined America would be a cesspool of freeloaders and the land of illegal immigrants therefore the system was not designed to permanently support these two groups that are being forced upon the working class and our tax system. Remove them from the tax base as they generate nothing but want everything for nothing, I don't care. I'm just sick of supporting the lunatic Democrat's policies and people, they are a useless group of people and have nothing to offer most of America unless I am one that supports the freebie system and/or I am a democrat who needs the voting pool, which I don't support nor do I need.

People are just pointing out the link between the horrible unemployment rate and the number of people who are here illegaly. Doesn't the word "illegal" mean anything? It is wrong to reward the illegals, political parties, the Federal Government and states like California, Illinois and Nevada who give illegal aliens welfare, food stamps, and free education. If America enforced the law these illegal aliens would go home and force by sheer numbers the governments of their countries to change.
    The Census should count every person in the country but distinguish between citizens and illegal aliens.

  16. I love Nevada. I own land up around Tonapah and it is magnificent. But the Census is to count the citizens of the United States, and then others. If you award Congressional Seats based on the number of illegal aliens in the district, it is contempt of the United States.

    I fully realize the door to Nevada has been opened, and the illegal aliens allowed to populate many areas. Live with them, and the beauty of their economic contributions dims very, very quickly. In order to examine the statistics on this issue, you have to go to the Bureau of Prisons, but when you do, you will discover they have incarceration rates that are far, far higher than any other ethnic group in the United States.

    I want them deported, and most Americans agree with that. Lets not pretend they are part of our country sos they can be counted for Congressional Seats, and then their welfare paid for out of Federal Funds. Lets obey the law: lets deport them.

We lived there for 5 yrs moved out in 04"...at that time we knew that this was going to happen, with all the illegals invading Las Vegas. I have thought of buying a place out there, again...for the winters, but, I just don't feel it is the safe place it used to be..sad, I would go grocery shopping at 1-2am..or go play Bingo at 4am, (by myself)..never thought a thing of it. Now, I would be afraid in the daytime!!! We also saw how the jobs were being taken by the illegals, as well...what started out to be lawn work for them (illegals) ended up to be taking jobs in construction..roads..Just about ALL the casino jobs..again too bad!!! We..Loved Vegas, really really miss being there...!!

  21. Don't the spend the time & money to change the questions, go ahead and count them. But at the same time, we need:
    - Real ID, eVerify, and significant employer penalties for hiring undocumenteds.
    - Aggressive law enforcement efforts to insure that any illegal arrested for any felony or violent crime is deported immediately after their incarceration is completed.
    - Much stronger border enforcement. Use the Guard, armed, if needed.
    - Some mechanism for registering those that remain along with a process for either deporting them (notably gangbangers & smugglers -- drug testing and tattoo checks will identify most of them) or incorporating them into a process for citizenship (law abiding, employed, women & children, educated, english speaking; expedited process for those who complete a term of service in the military).

    Dwindling economic opportunities along with getting rid of the worst should significantly reduce unemployment and crime rates. Toughening up the border will cut the flow (and reduce the criminal & terrist threat). And some process of registration should bring all but the remaining hardcore types out into the open.

    Deporting 12-12 million will not work (and shouldn't even be attempted). Many may want them out, but when we're forced to use detention camps to round them up and cattle cars to ship them into Mexico (the Mexican ones anyway, who make up the majority), the spectacle will be too much for the overwhelming number of Americans to accept. (And the resulting chaos & expenses will be worse than the Obamacare disaster shaping up in Congress.)

    In the end prior to the last national election there was a movement by both parties to encorage illegal immigrants and their causes to gain their votes.

  25. Both parties love illegals and their children even more so. Since this is the only population group that has been growing rapidly and continuously for decades. Yet there's never any mention of illegal Asians- that falls under SWPL.
    Through census or re-districting both parties try to get a larger share of the pie. The parties are not banking on a population group that has chosen to make itself extinct in a couple of decades. They now that it's all about numbers.

Whenever I read comments on an article about illegal immigration, the one thing that always strikes me is the automatic assumption that people make that illegal aliens don't pay taxes - how do you know this? The IRS and USCIS rarely share information, usually only during a criminal investigation, and the law was set up that way expressly to encourage people in the country illegally to pay their taxes.

    Nevada doesn't even have a State income tax so there is no tax to avoid, only Federal! I think we can safely assume they either own a home or are renting one, in which case the property taxes are being paid. Obviously they also pay sales tax.

    I remember talking to a guy who had a lawn business in California about 20 years or so ago and he told me the only reason he had set up a lawn business was to be self-employed so he could avoid immigration forms like I-9 - but he filed a 1040 every year. People waffling on about E-verify forget you can avoid the whole thing by being self-employed or starting your own company and filing a W-7 to get an ITIN.

    But yet these people who generally are at least paying property taxes directly or indirectly find that they cannot put their (illegal) kids in school because they can't get SSNs.

    The problem isn't enforcement of the law either, the problem is the law itself. The US immigration system is totally insane, it's the only immigration system in any developed country that heavily favours family-based immigration over employment-based immigration, i.e. it is far easier to get in if you have a close relative who is a US citizen than for an employer who needs you to sponsor you. There are only 140,000 visa numbers available every year for employment-based immigration, but there are usually 500,000+ for family-based and certain people (such as spouses) are exempt from the quota.

    My real pet peeve is when people say: "I'm perfectly okay with immigrants as long as they come in legally." If you'd ever had to immigrate into the US you'd know how ridiculous that statement is, the US has the most bureaucratic immigration system in the world. There are umpteen agencies involved in various parts of it: the State Dept., DHS, CBP, Dept. of Labor, Social Security Administration, DOJ, USCIS and so on. Assuming you even qualify (which you probably don't) navigating that system is very difficult. It's very easy to slip up on filing a form and find yourself in the country illegally, or worse yet, you timely file all the paperwork and USCIS or whomever take too long to process one bit of it and you miss some deadline. And this assumes you are fluent in English, and by "fluent" I mean fluent in American bureaucratese, not just able to speak the language!

On the other hand, there are allocation of funds for infrastructure and schools based on the count and this appears to be the correct thing to do. These folks are here and the monies given by the government should reflect it. But that doesn't mean that the government should not enforce immigration rules. The enforceement should occur at places of employment. The vast majority of them are here for jobs and if there are no jobs they won't be here.

    Now back to basics, by law (92 Stat. 915, Public Law 95-416, enacted on October 5, 1978), individual census records are sealed for 72 years. This figure has remained unchanged since before the 1978 law, reflecting an era when life expectancy was under 60 years, and thus attempts to protect individuals' privacy by prohibiting the release of personal information during individuals' lifetimes. The individual census data most recently released to the public was the 1930 census, released in 2002. Aggregate census data are released when available.

    That said, all Sen. David Vitter, R-La., and Sen. Robert Bennett, R-Utah are trying to do is derail the census from doing what it is suppose to do, count all the people who are living in America, no different than the first U.S. Census which was conducted in 1790 by Federal marshals. Census takers went door to door and recorded the name of the head of the household and the number of people in each household. There was only one catch, Slaves were enumerated, but only three out of five were counted for apportionment. American Indians, being neither taxed nor considered during apportionment, were not counted in the census and minorities where never counted. All this meant that only the WASP would indulge in the pie, and this has gone on for over a century and a half.

    I believe in the laws of America. The constitution never identified the people to be counted other than those pointed out in the above paragraph. Should we want to exclude any select group again we need to do it now, before the WASP loose all control of the House?

    Ethnocentrism is the tendency to look at the world primarily from the perspective of one's own culture, and to downgrade all other groups outside one's own culture. Some sociologists, such as Lawrence Bobo and Vincent Hutchings, say the origin of ethnic stratification lies in individual dispositions of ethnic prejudice, which relates to the theory of ethnocentrism. Continuing with Noel's theory, some degree of differential power must be present for the emergence of ethnic stratification. In other words, an inequality of power among ethnic groups means "they are of such unequal power that one is able to impose its will upon another". The different ethnic groups must be competing for some common goal, such as power or influence, or a material interest, such as wealth or territory. David Vitter-Bennett have been offering an amendment to the Commerce, Justice, and Science appropriations bill that would require the U.S. Census Bureau to add questions regarding immigration & citizenship status of 20 to 30 million plus illegal immigrants and families in the 2010 decennial census. If these questions are not asked it is certain that--ALL--these illegal aliens will be counted in the census and states will lose billions of dollars in federal funds to states infamously designated as SANCTUARY STATES such as CALIFORNIA and gain Congressional seats (and electoral college votes) due to this counting of illegal aliens.DEMAND FROM YOUR SENATORS THAT SEN. I suppose those most against immigrants will choose the higher end to justify their arguments. The must common number I've see was 12 million illegals. An estimated 37 million immigrants with approximately one third sa illegal. If the Mexican immigrants specifically, only half are illegal.
