The trial for a man accused of driving drunk in a head-on collision that left an 18-year-old UNLV freshman dead has been postponed.

Vladimir Lagerev, 45, was scheduled to stand trial beginning Monday on a charge of driving under the influence resulting in death in the April 15 head-on collision that killed 18-year-old Lindsay Bennett. The trial is now set for March.

Lagerev's attorney, Stephen Stein, requested the delay after telling District Court Judge James Bixler he had been seriously ill the week before and hadn't been able to adequately prepare for trial.

Lagerev has been out of custody since posting a $100,000 bond in June. As part of Lagerev's bail agreement, he has been ordered to wear an ankle bracelet to monitor his whereabouts and whether he has consumed alcohol. He has been required to surrender his passport, driver's license and marriage license.

Bennett, a Coronado High School graduate, died two days after the crash, which occurred about 9:30 p.m. April 15 on the Windmill off-ramp of Interstate 215. Police said her 2006 Honda was hit head-on by Lagerev's Acura, which police said he was driving the wrong way on the ramp.

Prosecutors say Lagerev had a blood-alcohol level of 0.20, more than twice the legal limit of 0.08.

Bennett died two days before her 19th birthday.

  1. Such a beautiful young woman, such a tragic senseless ending of her young life. I Can't understand why they would want to delay his trial? This seems like a cut and dry case. Prayers go out her family and friends and UNLV.

    He only had the case since April or so. Why didn't he prepare before then?
    Idiot lawyers.

  3. Delaying tactics will continue now that the killer is sitting in the comfort of his own home. Why bother rushing to trial when the outcome is fairly certain. As is the likelihood of serving time.

    I wonder if the judge asked the attorney for proof that he really was sick in bed ?

  5. Because it's a certified instrument he could possibly use to attest to his identity in another state to get a driver's license...there is no national database for driver's licenses or records, yet...

  6. elgato -- assuming you're commenting on my post, you're wrong. Try getting a driver's license in ANY state and you'll find your entire license and driving record history follows you everywhere. Even when a cop stops you it's an open book -- including all data entry errors.

    And he's wearing that anklet. Where's he going to go?

    The point -- did the state just un-marry him?

  7. KillerB, I have a California Drivers license and Im stationed in Texas, Im not required to renew as long as I have an Active Duty Military ID and if I am pulled over for any violation in that state, the state of California is not notified, so no its not an open book.

    I dont get how the judge would allow the delay, but I can see where his hands would be tied. Seems open and shut, such a tragedy

  8. SSGJeremy -- active duty military and federal employees on federal business, like Post Office, need neither license plates or drivers' licenses. That's why you don't see license plates on either. Park rangers and some others show plates.

    You get other privileges too, like you can't technically be sued while deployed. Tell that to some of the active duty who lost their kids and child support mounted while over there.

  9. On April 15th, 2009 Vladimir Lagerev made the decison to drive drunk, going the wrong way up an on ramp on to a major highway dodging cars. Ny niece Lindsay was on her way home from dance practice at UNLV when he hit her head on. With his blood alcohal level twice the legal limit. So now I read that because the lawyer was sick the week before the trial, it is now been changed to March 25, 2010. This lawyer has had this since April (6 and half months), what the hell is wrong with our legal system. This guy will now get to spend the holidays with his family while my sister, brother-in-law and my nephew suffer through their first holiday of many to come with out their daughter and sister. Tell me why this is OK, this is a perfect example of how screwed up our legal system is. I love you Lindsay!

  10. My daughter was a friend of Lindsay's. Such a senseless tragedy, and the family has conducted themselves with depth of character and integrity. They deserve closure, the sooner the better. What is the matter with "Judge" James Bixler? If the attorney was allegedly sick for a week, then postpone the trial for two weeks and give the "sick" attorney double time to prepare. And don't insult my intelligence, Bixler, by blathering about crowded court schedules. My brother is a REAL judge and I know that judicial preference in societal interest is widely used to pre-empt court schedules. Bixler goes in my book right next to Lance Ito for "not getting it." I think all who read this should raise a hue and cry to get the trial re-scheduled for as soon as possible.
