Military court would guarantee justice

I have serious reservations regarding the upcoming trial in New York City of the, dare I say, terrorists.

The decision by U.S. Attorney General Eric Holder to try these terrorists in a civil court rather than in a military court will have not only far-reaching complications for how the trial will proceed but also far-reaching security problems for our country. Holder states the evidence now on hand against these terrorists is more than sufficient to bring about their convictions.

We should all know that trials in civil courts provide loopholes not available in the military court system. From what I read, there will be plenty of loopholes that could possibly bring about a mistrial, dismissal or an outright acquittal.

I see nothing good for the U.S. government coming out of Holder’s decision.

  1. To the koolaid drinkers who live in the hypocrite echo chamber:

    1) Obama's adminstration is still using military tribunals

    2) Obama's adminstration is still planning to hold some indefinitely without any court trial or military tribunals

    3) Obama's adminstration was denying some detainees habeas corpus access to the courts. The Federal Courts rule that that the actions by the Obama adminstration were unconstitional. The Federal courts had to order Obama's adminstration to stop that denial of access.

    4) Obama's adminstration has order the murder's of suspected terrorists living in allied countries that also result in the death's of the suspected terrorist's wife, children and friends being murdered too. All that will not any due process for the suspected terrorist to challenge the evidence against him. Why not have the terrorist arrested in the allied country and turned over to the USA and have his rights read to him and give him a lawyer and drag him to a US court?

    Do the koolaid hypocrites challenge Obama? No

    Do the koolaid hypocrites whine about Obama? No

    Do the koolaid hypocrites say that Obama is a breaker of the US Constitution? No

    Do the koolaid hypocrites say that Obama should be impeached? No

    The only reason why the Obama administration is doing these US court trials is to appease the koolaid hypocrites.

    It is a rope-a-dope that Obama is peforming on the koolaid hypocrites and he is making fools out of them especially when they bable about why the US court are so great when at the same time Obama is doing stuff just like Bush.

    Go ahead koolaid drinkers. Go ahead and spout your bablings from your echo chambers.

    You look like fools and idiots.

  2. Khalid Sheikh Mohammed was captured in Rawalpindi, Pakistan on March 1, 2003, by the Pakistani ISI.

    The Administration, Congress, and the Supreme Court spent several years establishing a Military Tribunal.

    Obama was a major player and supporter of the Military Commissions Act of 2006 [HR-6166].

    The Supreme Court using a test low level combatant's case forced changes in the MCA on June 12, 2008.

    By January 2009, KSM had pleaded guilty in a Military Tribunal to 9/11. Leading up to the plead MSK relished publicly confessing his role in 9/11.

    Obama ordered a deferral of sentencing upon entering Office January 21, 2009.

    Justice deferred is Justice denied.

    Along with Fort Hood Hasen's terrorist investigation and trial, MSK's trial will serve to only further inflame people against Muslims and their communities.

  3. Holder will lose the ability to use most of the battlefield evidence gained legal case and classified information in court. KSM will be provided the same rights and legal privileges (like Hearsay and Miranda Rights) as a common US citizen New York street thug not those of a battlefield combatant.

    The attorney general, who personally opposes the death penalty, all but vowed to seek capital punishment against each of the five defendants. Maybe -- we know what the Military would do.

    The Federal Marshals concluded that only the Southern District of New York -- with its hardened courthouse, secure Metropolitan Correctional Center and underground transportation tunnels through which to bring defendants to and from court each day -- was safe enough to process the case. But that does nothing for the exposed Judge and jury when they go home every night.

    We already had a Supreme Court blessed Military Tribunal and guilty pleas in court.
    What are we gaining from moving the military cases to civilian court?

    One can only conclude that Obama and Holder subterfuge is they, the ACLU and the left, still want to "out" the "bug-in-the-Box" Enhanced Interrogation Techniques of the CIA and further a disassembly of the CIA; and are willing to take the risk of freeing these terrorist into our society and inciting an attack on New York or in Muslim communities.

  4. Since no one has been tried and convicted of causing the destruction on 9/11, who would KSM have been conspiring with?
    The city of New York recently turned down a request from 85,000 family members and friends of citizens killed by the attacks of 9/11, to vote on to open up an investigation on the events that took place that day and finally find an entity responsible for said events. Sadly enough their request was turned down. If the city is not interested in proving who was responsible for 9/11, why should they be interested if anyone conspired with anyone?

  5. Lanzrath, all -- you failed to mention the fundamental point here.

    here's no such thing as a military "court" -- courts are under the judicial branch of our republic, the military is completely under the control of the executive branch. Every person incarcerated under U.S. jurisdiction is entitled to Constitutional protections, including habeas corpus, a recent legal debate that never should have been. Take the case of Jose Padilla -- a U.S. citizen kept incarcerated by the military and purposely kept from the judiciary, including his attorney.

    Just one more thing Bush promised would never happen.

    Why talk about Bush?

    Obama is the one who is using military tribunals.

    Obama is the one who is planing to hold some detainees without even a military tribual.

    The judical branch had to order Obama to give habeas corpus rights to detainees.

    Hmmm.....perhaps this is all just an excerise in politics........Bush bad....Obama good....even though they are doing the same things.

  10. You don't have to be a genius to predict that there will be serious disruptions and most likely another major terrorist act to commemorate the New York trial venue. If you wave a red blanket in front of the bull's nose, he will charge and gore you. Obama and his surrogate AG Holder are the worst type of fools.

  11. This will be the 3rd attack on New York City since 1993
