Court rejects appeal of killer

CARSON CITY – A Las Vegas man sentenced to life in prison with the possibility of parole for the fatal baseball bat beating of his grandmother has lost his appeal to the Nevada Supreme Court.

Charles W. Brewington pleaded guilty to second- degree murder in the beating death of 63-year-old Verna Wright in her home in October 1995.

Brewington, now 32 and held at the state prison in Ely, maintains he was legally insane at the time of the crime.

The court said Brewington failed to present any specific facts to show he was mentally unbalanced. And it said Brewington failed to explain why he waited six years after the issuance of a Supreme Court decision involving the plea of guilty but mentally ill is unconstitutional.

The court upheld the decision of Clark County District Judge Jackie Glass that the petition was time barred.

Brewington applied for parole in June 2005 but was denied. There is also a conviction against him of battery of a police order for which he received a 2-5 year sentence.
