Banner on wall of building can remain

The large banner advertising rooms on the Boulder Inn and Suites' west-facing wall will remain, even though it doesn't comply with city rules.

The City Council Nov. 12 overruled the Planning Commission on the 392-square-foot sign, which appears to be painted on the building, but is a bolted vinyl fabric. The council decided with a 3-0 vote that the sign isn't temporary, but permanent. Councilman Mike Pacini and Councilwoman Andrea Anderson were absent.

Bret Caruso, an owner of the hotel at Nevada Way and Date Street, told the council he hadn't applied for a permit when the sign was installed early this year, and did so retroactively at the request of the city's code enforcement officer.

The Planning Commission had not issued a permit for the sign as it was constructed, declaring it too large for its temporary status on a secondary wall. The city's sign ordinance says signs on a secondary wall may be no larger than 5 percent of the wall space or 50 square feet.

City planner Susan Danielewicz said Caruso won't have to take the sign down and but will have to apply for a variance from the Planning Commission.

Caruso declined to comment on the decision.
