Although District Court Judge Donald Mosley pleaded with the Family Court to release his son, Michael Mosley, who was involved in a fatal wreck Friday night, the teenager will remain in juvenile detention for at least a week.

Henderson Police said that Michael Mosley, 16, was driving another vehicle under the influence of alcohol, not the pickup truck that flipped over and killed 15-year-old Olivia "Lynn" Hyten about 11:30 p.m. Friday.

Police said that Michael Mosley has had other traffic violations and that he was restricted to driving to and from school.

Judge Mosley released a statement late Sunday: "My heart goes out to the Hyten family. There is no doubt this is a terrible tragedy. We would ask that the system be given a chance to work. My son will not run from any responsibility he has in this situation."

Judge Mosley appeared in Family Court with his wife, Terri. The couple has been in a bitter custody fight over their son for the past decade.

Family Court Judge William Voy ruled Michael Mosley would remain in juvenile detention until a plea hearing Nov. 24.

The family of Olivia "Lynn" Hyten, who was a sophomore at Coronado High School, scheduled visitation and funeral services for this week.

Palm Mortuary in Green Valley said that visitation has been scheduled from 4 p.m. to 7 p.m. Tuesday at the Palm Mortuary Chapel at 7600 S. Eastern Ave.

Funeral services have been set for 11 a.m. Wednesday at Palm Mortuary, 7600 S. Eastern Ave., a mortuary spokeswoman said.

When Henderson police officers arrived at the scene at Grand Hills and Villa Barolo, near Eastern Avenue and Anthem Drive, a while Chevrolet Silverado truck with one teen driving and three others as passengers had lost control.

The driver went off the road and the pickup flipped, police said. Olivia Hyten was not wearing a seatbelt and was thrown from the truck, according to the coronor's office. The coroner's office listed her death as the result of multiple injuries from a motor vehicle crash.

Michael Mosley was in a red Ford F250 and apparently pulled up alongside the white pickup, police said.

No charges have been filed in the fatal crash.
