Pet store robbery case moves to district court

A woman arrested in an alleged robbery of a Henderson PetSmart will be tried on charges of robbery, kidnapping and using a deadly weapon in District Court, a judge has ruled.

Henderson Justice of the Peace Rodney Burr bound over to District Court all but one original charge against Mandy Hagen, 28, in the July 13 incident at the PetSmart on Stephanie Street near Warm Springs Road.

Deputy Public Defender David Westbrook argued that use of a deadly weapon enhancements should be stripped from many of the charges against Hagen, because a police officer testified last Thursday that the weapon in question was not a "real gun." Deputy District Attorney Kristen Lynch confirmed today that the weapon was a pellet gun, which she said can cause bodily harm.

Westbrook had also sought to dismiss all kidnapping charges, contending that the movement restrictions were the minimum necessary to complete a robbery. Lynch agreed to voluntarily drop one kidnapping charge related to the detention of store manager Jasmine Holland, who opened the safe for Hagen.

Hagen faces 12 charges: burglary with a firearm, robbery with a deadly weapon, three charges of first-degree kidnapping with a deadly weapon, first-degree kidnapping of a victim age 60 or older with a deadly weapon, assault with a deadly weapon, failure to stop for police, two counts of child endangerment, battery of a victim age 60 or older with a deadly weapon, assault of a victim age 60 or older with a deadly weapon.
