Letter: Private ownership is no excuse to flout law

Sunday, May 13, 2007 | 7:02 a.m.

Jack Nino's May 6 letter, "Smoking ban does pick on bar owners", requires a rebuttal.

He states, "The government has no business regulating activities like smoking in privately owned bars and taverns " Businesses may be privately owned, but they become public places when they open for business, and therefore are required to follow the law, whether or not they are in agreement with it. Civil disobedience is breaking the law, regardless of how they try to justify it.

Regarding Mr. Nino's statement about the government regulating private businesses, I would liken that to OSHA turning its back on conditions which are dangerous or unhealthy .

Smoking in food establishments is hazardous and unhealthy for the patrons.

Since the law was passed, those establishments should comply. I applaud the law and those who comply with it.
