Letter: Question 5 just wasn’t bold enough

If Question 5 is deemed unconstitutional, it is because it was written in a timid fashion. It should have included banning smoking in all public areas. Then we would have a level playing field and the true will of the people would best be served. The result would be constitutional.
Put Question 5 back out as soon as possible for a revote, but the next time include a ban on smoking in all public areas. It's time we quit playing games with the smoking issue and get past this.
Small business is the sacrificial lamb as it stands now, while we allow big business to continue to allow smoking. How fair is that?
After all, smoking may be a choice, but breathing is a necessity. One is an option while the other is a right we all have as human beings. No one has the right to impede breathing, for to do so is inhuman. I hope many smokers will take responsibility and quit for the sake of their family and friends. I'm glad to say I was successful doing so myself.
