Ross sues Walgreen over bins, parking

Ross Stores Inc. has filed a lawsuit against Walgreen Co., alleging the Walgreens store adjacent to the Ross Dress For Less store on Las Vegas Boulevard has improperly placed storage bins and parking signs in Ross' parking lot.

Ross Stores said in a May 11 court filing in Clark County District Court that the Walgreens parking signs imply that only Walgreens customers can park in an area that includes spaces for Ross customers.

Ross Stores said that the storage bins and the parking sign jeopardize Ross' reputation as the International Council of Shopping Centers annual convention continues at the Las Vegas Convention Center in court filings. The convention ends Wednesday.

Ross Stores is seeking a court order forcing Walgreens to remove the bins and the signage from Ross' parking lot.

Michael Polzin, a Walgreens spokesman, declined to comment on the lawsuit. Neither a spokeswoman or attorneys for Ross Stores could be reached for comment.

The lawsuit also names as defendants the owners of the property the Ross and Walgreens stores are situated on including Passco Silver City S LLC, Passco Silver City H LLC, Delongre Las Vegas LLC and 3025 LVBS LLC.

Passco Property Management Inc., the property manager was also named as a defendant in the suit. Representatives of those parties could not be reached for comment.
