Court refuses to hear appeal of Lewis casino referendum

Thursday, May 12, 2005 | 9:05 a.m.

CHARLESTON, W.Va. -- Gambling opponents in Lewis County have lost their appeal of a countywide referendum in which voters overwhelmingly supported plans to turn the former Weston Hospital into a hotel and casino.

The state Supreme Court voted 4-0 this week not to hear the appeal of Lewis County Circuit Judge Thomas Keadle's decision to uphold the November referendum. Justice Larry Starcher did not participate in the vote.

The Lewis County Coalition Against Gambling Expansion and the county Ministerial Association had sued to stop the referendum, claiming the Civil War-era psychiatric hospital does not meet the state's criteria for a casino and that the ballot question was improperly worded.
