Supreme Court rejects appeal

CARSON CITY -- The Nevada Supreme Court Tuesday rejected the appeal of Richard C. Gaston, sentenced to life in prison with the possibility of parole for his part in the murder of a Las Vegas man outside a Las Vegas restaurant in 1993.

Gaston and two other men were involved in a robbery attempt of Mario Wesley and a friend. Gunfire was exchanged and Wesley was killed and his friend wounded.

Gaston pleaded guilty to first-degree murder with use of a deadly weapon in June 1994. He received consecutive life terms.

The Supreme Court in September last year directed the District Court to correct the judgment to reflect that each sentence had a ten-year minimum term before Gaston would be eligible for parole.

Gaston appealed the decision of District Judge Nancy Saitta who fixed the sentence. The court said Saitta properly corrected the sentence.
