Three children hurt in crash

Three children, including a 4-year-old who suffered critical injuries, were taken to University Medical Center after three vehicles crashed in northwest Las Vegas, Metro Police said.

The children were riding in a 1998 Ford Contour which apparently did not stop at a red light at Cheyenne Avenue and Torrey Pines Drive at 4:08 p.m. Monday, police said.

The names of the children were not released. A 3-year-old was in serious condition and a 12-year-old received moderate injuries, police said.

The Ford hit a 1997 Dodge Dakota eastbound, which then hit a 1997 Toyota Camry waiting to make a left turn south on Torrey Pines, police said.

All three drivers received minor injuries, including 29-year-old Kelly Gregg of Las Vegas driving the Ford, police said.

The investigation was ongoing this morning.

Driver suffers critical injuries

The 51-year-old driver of a 2000 Daewoo Lanas trying to enter Tropicana Avenue from a private driveway at 1:45 p.m. Monday suffered critical injuries in a collision with a 2002 Nissan Pathfinder, Metro Police said.

Joyce White, the Daewoo driver, was taken to Sunrise Trauma Center and admitted to the hospital in critical condition, police said.

White was trying to go west on Tropicana Avenue near McLeod Drive when the crash occurred, police said.

The driver of the Nissan, Jorge Barahona, 32, of Las Vegas, suffered minor injuries minor injuries.

The accident was still under investigation by police, but witnesses and evidence at the scene indicated White failed to yield the right-of-way to Barahona, police said.

Man killed by van identified

A man who was hit and killed by a van while jaywalking across Charleston Boulevard near Fourth Street on Monday has been identified as Danny Lorenzo Pollard, 46.

Pollard was struck by a 1998 Ford Econoline van driven by David Grondel, 48, of Las Vegas about 7:30 a.m. as he ran across Charleston outside of the crosswalk, police said. Pollard was pronounced dead at the scene.

District court to decide payment

The Nevada Supreme Court Monday ordered a district court hearing to determine whether a man who sued the Reserve Hotel & Casino in Henderson and lost must pay $19,254 in attorney fees of the business.

The court said District Judge Valorie Vega must hold a hearing to determine if the suit by Alvaro Lizzaralde Jr. was reasonable or was brought to harass the hotel casino.

Lizzaralde and his girlfriend had drinks at the resort in March 1998 and then left. The parking lot valet Chris Schmitz said he saw Lizzaralde pull the hair of the woman and then hit her several times. He summoned security, and Lizzaralde was arrested on a charge of domestic violence but it was later dropped.

Lizzaralde sued the hotel and Schmitz for false arrest and other allegations. A jury in July 2003 found in favor of the defendants and the judge awarded them $19,254 to pay lawyers.

The court said that before attorney fees can be awarded "there must be evidence in the record supporting the proposition that the complaint was brought without reasonable grounds or to harass the other party."

Lizzaralde had offered to settle the case for $10,000 and the Reserve offered $1,250 before the trial to end the suit.

Court denies killer's petition

The Nevada Supreme Court on Monday denied the petition of James Nellums, convicted of killing a man and wounding the man's son in a robbery attempt in North Las Vegas in March 1997.

Nellums, now 39, contended his lawyer was ineffective at this trial for failing to move to suppress a gun discovered during a search of Nellums' apartment. He also said the lawyer failed to locate a knife that allegedly was used against Nellums by 53-year-old Nicholas Rodriguez and his son Eliaro, who was 20 at the time of the attack.

The court said the claims were without merit.

Nellums is serving consecutive prison sentences of 20 years to life.

Nellums was accused of approaching the victims and asking them something in English. Neither the father nor the son spoke English and didn't answer. They were then shot.
