Two men charged in the 2002 killing of a man who allegedly refused to assist in paying for his ex-girlfriend's abortion were sentenced to prison Thursday, but the girl who asked them to confront the victim was sentenced to probation.
On Sept. 26, 2002, John Segura was killed after being confronted by 23-year-old Sam Cohen and 24-year-old Jeremy Naylor for allegedly failing to assist Kristina To in paying for her abortion.
Cohen, who confessed he was the shooter, previously pleaded guilty to one count of second-degree murder and was sentenced to 10 to 25 years in prison by District Judge Donald Mosley on Thursday.
Mosley sentenced Naylor, who confessed to driving Cohen to Segura's apartment at 5419 W. Tropicana Ave., to 2 to 8 years in prison for one count of voluntary manslaughter with use of a deadly weapon.
To, however, who asked Naylor to confront Segura, gave him the directions to Segura's home and even made a phone call luring Segura outside his home to be confronted, was given a suspended sentence of 1 to 3 years in prison by Mosley and placed on five years of probation.
Naylor, who was dating To's sister at the time of the killing, admitted he was contacted by To while he, Cohen and others were drinking at the Orleans, according to the police report.
He told authorities To asked him to "contact Segura and convince him to stop bothering To along with retrieving half the money needed for an abortion." After stopping at Cohen's home to "smoke methamphetamine" Naylor said they proceeded to Segura's apartment.
Naylor said he took To telling him to convince Segura meant to "possibly beat Segura up" according to the report.
Although Naylor contends he simply drove Cohen over to Segura's apartment knowing Cohen had a handgun, Cohen told police it was Naylor who confronted Segura and Cohen shot Segura because he believed Segura was armed.
Police found two BB guns in Segura's possession at the scene.
