Firearm charge leads to 9-year sentence

A seven-time convicted felon who was shot in a gunfight with police in 2001 was sentenced to 9 1/2 years in federal court on Monday for felony possession of a firearm.

U.S. District judge Roger Hunt sentenced Harry "H Bomb" Kondiles to serve 115 months plus time served as a result of Kondiles pleading guilty in May to felony possession of a firearm, said Natalie Collins, spokeswoman for the U.S. Attorney's office.

Kondiles had been indicted on the felony possession of a firearm charge in January 2003, she said.

The plea agreement filed in federal court stated that Kondiles pleaded guilty to one count of a felon in possession of a firearm.

The plea agreement stated that his sentence could be enhanced because Kondiles used or possessed the firearm in connection with another felony.

Hunt said the sentence was appropriate given Kondiles' past record.

"I based the sentence primarily on his criminal history and the circumstances of the crime itself," Hunt said.

The federal case was prosecuted by assistant U.S. Attorney Thomas Dougherty.

Kondiles was indicted of the weapons charge in January 2003 and still faces multiple state charge. He was indicted in May 2002 in Clark County District Court of three counts of assault with a deadly weapon, two counts of discharging a weapon out of a vehicle and one count each of attempted murder, possession of a stolen firearm, evading police and battery with use of a deadly weapon, according to news reports.

Kondiles was involved in the shootout with police in 2001. He was shot more than 20 times by 14 police officers during the gunfight.

At the time of the incident, detectives were searching for him because he had 17 outstanding warrants, according to previous reports.
