Supreme Court rejects appeal in LV killing

CARSON CITY -- The Nevada Supreme Court on Thursday rejected the appeal of Cedric Flemons, a 21-year-old Las Vegas resident convicted of the fatal shooting of his friend in December 2001.

Flemons' appeal was based on his claim that his lawyer had failed to properly investigate his defense to first-degree murder. Flemons says he and the victim, 19-year-old Robert Lashley, had an argument and Lashley pulled a gun and fired two shots at him.

The bullets missed and the two men struggled. Flemons claimed he accidentally shot the victim.

The court rejected Flemons' claim. It also turned down the argument that Flemons did not know the consequences when he pleaded guilty to first-degree murder.

Flemons was sentenced to a life term with the possibility of parole plus 12-30 years for stealing the victim's PlayStation 2 video game. The robbery sentence runs consecutive to the murder charge.

The Supreme Court denied his first appeal in September 2003.
