Man to stand trial in slaying in Wal-Mart parking lot
Tuesday, Oct. 19, 2004 | 9:40 a.m.
A man accused of beating to death a retired Air Force major in a Wal-Mart parking lot will stand trial, Justice of the Peace Nancy Oesterle ruled today.
Raymond Garrett's case was sent to District Court based on a preliminary hearing that stretched over three weeks.
Garrett, 37, faces charges of murder, battery, robbery and conspiracy to murder for the death of 51-year-old Michael Born, who lingered in a coma for two weeks after the attack in June.
On Monday a witness, Osha Danial, testified that as she got off the bus and headed for the store, she saw a pair of figures in the parking lot.
"There was like a flash, and I looked over in that direction and I seen a man that was kind of like on top of someone else," Danial said.
Danial said the man's large, muscular build matched Garrett's, but she couldn't tell if it was the same person. The attack on Born in the parking lot of the Wal-Mart at Stewart Avenue and Nellis Boulevard was captured on surveillance videotape. Police said that helped them identify Garrett.
