Ballot Question 3, the "Keep Our Doctors in Nevada" initiative, proposed by physicians, would change the 2002 law by:
PRO: The physicians who proposed "Keep Our Doctors in Nevada" argue that doctors have been forced to close their practices or leave the state because of the high cost of malpractice insurance. They believe this initiative will help lower doctors' insurance rates by making the size of malpractice settlements and judgments more predictable.
CON: Plaintiffs' lawyers, who oppose this measure, believe caps on damages for pain and suffering are unfair to injured plaintiffs and put unconstitutional restrictions on juries. Lawyers also believe doctors have exaggerated the impact high malpractice insurance rates have had on the availability of health care.
