Trial continues for last 311 Boyz suspect
Thursday, May 27, 2004 | 10:59 a.m.
The trial of alleged 311 Boyz gang member Scott Morse continued today, with prosecutors planning to call seven of the nine alleged members of the gang originally charged in the rock throwing attack of Stephen Tanner Hansen to testify.
Matthew Costello, 18, Christopher Farley, 18, Anthony and Brandon Gallion, 16, Steven Gazlay, 19, Dominick Harriman, 20, and Jeff Hart, 17, are all listed on the state's notice of witnesses against Morse.
Morse, the only alleged 311 Boyz member who did not accept a plea deal, faces three counts of attempted murder with use of a deadly weapon, as well as multiple counts of coercion and battery with use of a deadly weapon in the trial that began Wednesday before District Judge Michael Cherry.
The charges stem from a July 18, 2003, house party, where Morse and his former co-defendants are accused to starting a fight and preventing Hansen and his friends Craig Lefevre and Joseph Grill from leaving.
Once Hansen, Lefevre and Grill tried to leave in Hansen's car, the alleged 311 Boyz gang members are accused of throwing rocks "the size of softballs" at the car, one of which, broke through the windshield and crushed Hansen's face.
Alleged 311 Boyz members Ernest Aguilar,17, Brandon Gallion, Farley, Hart, Costello, and Gazlay, all reached plea agreements with the state using Alford pleas on charges connected to the Hansen attack.
Under an Alford plea a defendant does not admit guilt but agrees the state could prove its case.
Anthony Gallion, 16, had his charges dismissed without prejudice, meaning prosecutors still could charge him at a later date.
Harriman entered a plea agreement to the charge of conspiracy to commit coercion. As long as he pays a $2,000 fine and "stays out of trouble for a year," he will face no other punishment for his involvement in the attack.
