Parents of child killed at speedway file lawsuit

The parents of a 5-year-old boy who died after crashing on the child's section of the Las Vegas Motor Speedway have filed a wrongful death lawsuit in District Court.
Bernadine and Jocelyn Santos' son, Tyler, was killed June 24 when he crashed while racing in the "pee wee" section of the speedway.
The couple is seeking more than $10,000 in damages. The speedway, Club MX, which sponsored the race, and club owners Richard and Heather Gould, are named as defendants.
The suit, filed by attorney Jason Awad, claims Tyler Santos suffered blunt force head trauma when he drove into an embankment. The suit claims the crash occurred "due to improper design, construction or maintenance of said 'pee wee' motor cross track."
Awad alleges the designers of the track were negligent because they did not install a safety device such as a netting or soft barrier between the track and the incline. Tyler was wearing a helmet at the time of the crash.
